TO GOVERN THE OPENING OP THE WASHINGTON STREET HIGHWAY
BRIDGE AND THE NEW YORK, NEW HAVEN & HARTFORD RAILROAD
BRIDGE ACROSS THE NORWALK RIVER AT NORWALK, CONNECTICUT

The Law The R iver and H arbor A ct o f August 18,1894, contains the following section:
S e c t io n 5. That it shall be the duty of all persons own ing, operating, and tending the drawbridges now built, or Which may hereafter be built across the navigable rivers and other waters of the United States, to open, or cause to be opened, the draws of such bridges under such rules and regulations as in the opinion of the Secretary of W ar the public interests require to govern the opening of drawbridges fo r the passage of vessels and other water crafts, and such rules and regulations, when so made and published, shall have the force o f law. Every such per son who shall w illfu lly fa il or refuse to open, or cause to be opened, the draw of any such bridge fo r the passage of a boat or boats, or who shall unreasonably delay the opening of said draw after reasonable signal shall have been given, as provided in such regulations, shall be deemed guilty of a misdemeanor, and on conviction thereof shall be punished by a fine of not more than two thou sand dollars nor less than one thousand dollars, or by imprisonment in the case of a natural person fo r not exceeding one year, or by both such fine and imprison ment, in the discretion of the court: Provided, That the proper action to enforce the provisions of this section may be commenced before any commissioner, judge, or court of the United States, and such commissioner, judge, or court shall proceed in respect thereto as authorized by law in case of crimes against the United States: Provided further, That whenever, in the opinion of the Secretary of War, the public interests require it, he may make rules and regulations to govern the opening of drawbridges fo r the passage of vessels and other water crafts, and such rules and regulations, when so made and published, shall have the force of law, and any violation thereof shall be punished as hereinbefore provided.

The Regulations In pursuance of the foregoing law, the follow ing regula tions are prescribed to govern the opening of the W ashing ton Street highway bridge and the New York, New Haven &
Hartford Railroad bridge across the Norwalk R iver at Nor walk, Connecticut.
1. The owners of, or agencies controlling the abovenamed bridges shall provide the appliances and personnel necessary fo r the safe, prompt and efficient operation of the draw.
2. The draw shall be opened prom ptly when the signal, hereinafter prescribed fo r the opening of the draw, is received from an approaching vessel or other water craft which cannot pass under the closed draw except as here inafter provided.

Sound Signals:
Draw to be opened im m ediately: Same as call signal.
Draw cannot be opened immediately, or, if open, must be closed imm ediately: 2 long blasts of a horn or whistle, to be closed im m ediately: 2 long blasts of a horn or whistle, to be repeated at regular intervals until ac knowledged by the vessel.
Visual Signals:
Draw to be opened im m ediately: A white flag by day or a green light at night swung up and down vertically a number of times in fu ll sight of the vessel.
Draw cannot be opened immediately, or, if open, must be closed im m ediately: A red flag by day, a red ligh t by night, swung to and fro horizontally in fu ll sight of the vessel, to be repeated until acknowledged by the vessel.
By the vessel Vessels or other water craft having signaled fo r the opening o f the draw and having received a signal that the draw cannot be opened immediately, or if open must be closed immediately, shall acknowledge said sig nal by one long blast follow ed by a short blast, or by swinging to and fro horizontally a red flag by day and a red ligh t by night.
Exceptions
The highway bridge: Closed periods when the draw need not be opened except fo r vessels drawing at the tim e more than 14 feet of water:

The railroad bridge: Closed periods when the draw need not be opened:
W hen signal fo r opening the bridge is given between the hours of 7:00 a. m. and 9:00 a. m., or between 4:00 p. m. and 6:00 p. m. and lew tide is predicted in the tide tables pub lished by tiae United States Coast and Geodetic Survey to occur within 1 hour before or after the time when such signal is given, the opening of the bridge may be delayed not to exceed 20 minutes from the tim e such signal is given.
Provided, however, that when a train scheduled to pass be yond the bridge without stop has passed the last station nearest the bridge and is in motion toward the bridge, the bridge need not be opened until the approaching tram has beeh brought to a stop.
4. A copy of these regulations shall be conspicuously posted on both the upstream and downstream sides of the bridge in such m annej that it can be easily read at any time.
5. These regulations shall take effect and be in force on and after the date o f approval hereof and the regulations approved June 21, 1933, to govern the operation of the above named bridges are hereby revoked.

To be used in conjunction w ith sound signals when conditions are such that sound signals cannot be heard.
