What authorizes DCAS to make this rule? Sections 1043, 811 and 814 of the City Charter and Section 15, 20 and 50 of the New York Civil Service Law authorize DCAS to make this proposed rule. This proposed rule was not included in DCASs regulatory agenda for this Fiscal Year because it was not contemplated when DCAS published the agenda.
Where can I find the DCAS rules? The DCAS rules are in title 55 of the Rules of the City of New York.
What laws govern the rulemaking process? DCAS must meet the requirements of Section 20 of the Civil Service Law and Section 1043 of the City Charter when creating or changing rules. This notice is made according to the requirements of Section 20 of the Civil Service Law and Section 1043 of the City Charter.
Pursuant to Section 1043d4 of the City Charter, this proposed rule does not require certification by the Mayors Office of Operations and the Law Department before publication of this notice because it involves only the modification of a fee.
Statement of Basis and Purpose of Proposed Rule Pursuant to Section 154 of the New York Civil Service Law and Section 811 of the City Charter, the commissioner of Citywide Administrative Services has all of the powers of a municipal civil service commission set forth in the New York Civil Service Law.
Section 501 of the Civil Service Law provides that the merit and fitness of applicants for positions which are classified in the competitive class shall be ascertained by such examinations as may be prescribed by the municipal civil service commission. Section 503
provides that a municipal commission shall require prospective

applicants for competitive class positions to file a formal application in which the applicant sets forth his or her background, experience and qualifications for the position sought, and merit and fitness for the public service. Section 505a requires every such applicant to pay an application fee to the municipal commission in an amount prescribed by that section. Section 505b authorizes a municipal civil service commission to waive application fees for specific classes of candidates.
The Department of Citywide Administrative Services has promulgated General Examination Regulations, codified at Title 55 of the Rules of the City of New York R.C.N.Y., Chapter 11, for the administration of examinations for applicants for positions classified in the competitive class. Section 11-01c1 sets forth the application fees required to be paid at the time of application. The rule further provides that the application fee of a veteran of the armed services of the United States shall be waived one time. 55 R.C.N.Y. 11-01c6.
This proposed rule would amend section 11-01c6 to eliminate the once only waiver for veterans and provide that the application fee will be waived for every examination for which a veteran may apply.
The City of New York has found that military veterans are especially well-prepared by experience, training, physical fitness and discipline to provide public service. It is also the unfortunate fact that veterans often encounter difficulty integrating themselves into the economic life of the country when they leave military service. Amending the rule to waive fees on every examination for which a veteran applies will expand the pool of highly prepared candidates available for service to the City while ensuring that candidates who have honorably served our country will be able to continue to provide public service.
DCASs authority for these rules is found in sections 15, 20 and 50 of the New York Civil Service Law and sections 1043, 811, and 814 of the New York City Charter.

Amendment of Rule Relating to Civil Service Examination Application Fees.
Section 1. Paragraph 6 of subdivision c of section 11-01 of title 55 of the Rules of the City of New York, relating to application fees for civil service examinations, is amended to read as follows:
6 Veteran Exam Fee Waiver.
i An application fee for an open-competitive or promotion civil service examination will not be required of a Veteran for taking one such any examination, under the conditions detailed in this paragraph.
A Veteran, for the purposes of this paragraph, shall mean an individual who, at the time of filing his or her application for a civil service examination, i is a citizen of the United States or an alien lawfully admitted for permanent residence, ii has received an honorable discharged or who has been released under honorable conditions from the Armed Forces of the United States, and iii has served on full-time active duty, other than active duty for training.
The Armed Forces of the United States shall mean the United States Army, Navy, Marine Corps, Air Force, and Coast Guard, including all components thereof, and the National Guard when in the service of the United States pursuant to call as provided by Law.
The Veteran Exam Fee Waiver can be used once by a Veteran to waive the application fee for an any open-competitive or promotion civil service examination offered by the Department of Citywide Administrative Services or offered by any other agency or entity pursuant to a delegation from the Department.
ii Process for Requesting the Veteran Exam Fee Waiver.
To request the Veteran Exam Fee Waiver, an applicant must submit a photocopy of his or her U.S. Armed Forces separation papers DD214
long form in the manner and at the time detailed on the Fee Waiver Request Form, available at Application Centers and at the website of the Department of Citywide Administrative Services at www.nyc.gov/dcas.
