annual base rent shall be $410,626.00, payable in equal monthly installments at the end of each month. The first five 5 months of base rent shall be abated. In addition, within 90 days after the Landlords substantial completion of the Life & Safety scope of work, Tenant shall pay Landlord a lump sum amount equal to the sum of $23,305.80 per month for the period from May 1, 2017 until the lease renewal commencement date prorated for any partial month, representing the difference between the monthly rent paid by Tenant under the holdover provisions of the expired original lease and the new base rent payable under the lease renewal for the same period.
The renewal of the lease may be terminated by the Tenant at any time, provided the Tenant gives the Landlord at least 90 days prior written notice.
Landlord shall, at its sole cost and expense, perform Life & Safety scope of work which is attached to the lease renewal.

IN THE MATTER OF an amendment of the lease for the City of New York, as tenant, relating to the ground floor portion of the premises demised by the lease at the building, located at 96-05 Horace Harding Expressway Block 1918, Lot 114 in the Borough of Queens for the Department of Environmental Protection.
According to the proposed amendment of the lease, the Landlord shall prepare final architectural and engineering plans and make alterations and improvements in accordance with preliminary architectural plans and specifications which are attached to the lease. The alterations and improvements consist of Base Building Work and Tenant Work, which the landlord shall provide at its sole cost and expense, as well as Equipment. The total cost of the Equipment shall not exceed $235,805.
The Tenant shall reimburse the Landlord for Equipment cost, to be disbursed upon the substantial completion of the alterations and improvements.
In the event that this lease and the lease 59-17 Junction Boulevard are not renewed by the Tenant before June 30, 2022, the Tenant shall pay to the Landlord the restoration fee in the amount of $250,000 and reimburse the Landlord for the Base Building Work and Tenant Work costs, not to exceed $2,400,649.

The annual rent shall be $500,000.00 from lease execution to Substantial Completion; $825,000.00 from Substantial Completion through Year 5;
$955,750.00 from Year 6 through Year 10; $1,056,565.00 from Year 11
through Year 15; and $1,168,570.00 from Year 16 through expiration, payable in equal monthly installments at the end of each month. In addition, Tenant shall pay to Landlord, a one-time, lump sum payment equal to the total value of $20,632.50 per month times the number of months from January 21, 2019 to lease execution.
Upon no less than eighteen 18 months prior written notice, the proposed lease may be terminated by Tenant, in whole, effective the last day of the 102nd month, the last day of the 138th month, or the last day of the 198th month following the Substantial Completion Date.
Tenant shall have two options to renew the lease for periods of five 5
years each at an annual rent equal to $1,355,925.46 for the first five-year period and $1,559,314.40 for the second five-year period.
The Landlord shall prepare final architectural plans and engineering plans and make alterations and improvements in accordance with specifications which are attached to the Lease. The alterations and improvements consist of Base Building Work, which the Landlord shall provide at its sole cost and expense, and Tenant Work, which the Landlord shall also provide at its sole cost and expense.
