IN THE MATTER OF a lease for the City of New York, as tenant, of the entire 10th floor of the building located, at 60 Bay Street Block 5 &
Lot 51 in the Borough of Staten Island for the Raise the Age program of the Law Department to use as an office, or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.
The proposed use was approved by the City Planning Commission, pursuant to NYC Charter Section 195 on October 26, 1994 CPC Appl.
No. N 950145 PXR, Public Hearing Cal. No. 108.
The proposed lease shall be for a period of twenty 20 years from Substantial Completion of alterations and improvements, at an annual rent of $248,543.12 for the first five 5 years, $274,087.12 for the following five 5 years, $299,631.12 for the following five 5 years and $325,175.12 for the last five 5 years, payable in equal monthly installments, at the end of each month. The rent for the first four 4
months shall be abated.
The lease may be terminated by the Tenant, at the tenth 10th and fifteenth 15th year anniversaries of rent commencement, provided the Tenant gives the Landlord two hundred and seventy 270 days prior written notice. In the event that the lease is terminated by Tenant, Tenant shall pay Landlord the unamortized portion of the Tenant Representative brokerage commission, the Tenant Work Cost and the Rent Abatement, amortized using a six percent 6.0%.
The Tenant shall have two rights to renew the lease for a period of five 5 years each, at 95% Fair Market Value.
The Landlord shall, at its sole cost and expense, prepare final architectural plans and engineering plans and make alterations and improvements in accordance with preliminary architectural plans and specifications which are attached, to the lease.
