Findings. 1 Pursuant to the mar keting agreement, as amended, and Order No. 69, as amended 7 CFR Part 969; 22 F. R. 3513, regulating the han dling of avocados grown in south Florida, effective under the applicable provisions of the Agricultural Marketing Agreement Actof 1937, as amended <7 U. S. C. 601
et seq.; 68 Stat. 906, 1047, and upon the basis of the recommendations of the Avocado Administrative Committee, es tablished under the aforesaid marketing agreement and order, and upon other available information, it is hereby found that the limitation of handling of avo cados, as hereinafter provided, will tend to effectuate the declared policy of the act.
2 It is hereby further found that is impracticable, unnecessary, and con trary to the public interest to give pre liminary notice, engage in public rulemaking procedure, and postpone the effective date of this amendment until 30 days after publication thereof in the F ederal R egister 60 Stat. 237; 5 U. S. C.
1001 et seq. in that the time intervening between the date when information upon which this amendment is based became available and the time when this amendment must become effective in order to effectuate the declared policy of the act is insufficient; and this amend ment relieves restriction on the handling of avocados.
I t is therefore ordered, That the provi sions of paragraph b 1 of 969.314
