SECOND APPORTIONMENT OP FOOD ASSIST
ANCE FUNDS PURSUANT TO NATIONAL
SCHOOL LUNCH ACT, FISCAL YEAR 1951
Under this amendment there will be made available to the State educational agency of Massachusetts the funds ad ministratively allocated for non-profit private schools in Massachusetts for the months of May and June 1951, in order to implement the transfer of responsi bility, as of May 1,1951, for administra tion of the National School Lunch Program in non-profit private schools in Massachusetts from the United States Department of Agriculture to the State educational agency, in accordance with the decision of the Attorney General of Massachusetts dated March 26, 1951, that the State educational agency has legal authority to administer such pro gram in the non-profit private schools.
Pursuant to sections 4 and 10 of the National School Lunch Act, the second apportionment of food assistance funds for the fiscal year 1951 16 P. R. 3885, is hereby amended by changing the funds apportioned to the Common wealth of Massachusetts as follows:

LIMITATION OF SHIPMENTS

P. R. 3612, regulating the handling of lemons grown in the State of California or in the State of Arizona, effective un der the applicable provisions of the Ag ricultural Marketing Agreement A,ct of 1937, as amended 7 U. S. C. 601 et seq., and upon the basis of the recommenda tion and information submitted by the Lemon Administrative Committee, estab lished under the said amended market ing agreement and order, and upon other available information, it is hereby found that the limitation of the quantity of such lemons which may be handled, as hereinafter provided, will tend to effec tuate the declared policy of the act.

It is hereby further found that is impracticable and contrary to the pub lic interest to give preliminary notice, engage in public rule-making proce dure, and postpone the effective date of this section until 30 days after publica tion thereof in the F ederal R eg ister 60
Stat. 237; 5 U. S. C. 1001 et seq. because the time intervening between the date when information upon which this sec tion is based became available and the time when this section must become ef fective in order to effectuate the de clared policy of the act is insufficient, and a reasonable time is permitted, under the circumstances, for prepara tion for such effective time; and good cause exists for making the provisions hereof effective as hereinafter set forth.
