Whereas, under the provisions o f Pub lic A ct No. 10, 73d Congress, as amended, and as reenacted and amended by the Agricultural Marketing Agreement Act o f 1937, as amended, hereinafter re ferred to as the act it Is provided that the Secretary o f Agriculture o f the United States hereinafter referred to as the Secretary shall, subject to the provisions o f said act, issue orders regu lating such handling o f certain agri cultural commodities, including hops, as is in the current of interstate or foreign commerce, or which directly burdens, ob structs, or affects interstate or foreign commerce in such commodities; and Whereas, the Secretary having reason to believe that the issuance o f an order would tend to establish and maintain such marketing conditions fo r hops grown in the States o f Oregon, Cali fornia, and Washington as would estab lish prices to the producers o f such hops at a level that would give such hops a purchasing power w ith respect to a rti cles that such producers buy equivalent to the purchasing power o f such hops in the base period, August 1909-July, 1914, did, pursuant to the provisions of the act and the regulations thereunder, on the 27th day o f May, 1938, give notice o f a hearing1 to be held at Santa Rosa, California, on June 14, 1938, and in Salem, Oregon, on June 17, 1938, and in Yakima, Washington, on June 20, 1938, on a proposed m arketing agreement and a proposed order regulating the handling o f hops grown in the States o f Oregon, 1 8 F. California, and Washington, at which times all interested persons in attend ance at such hearing were afforded due opportuity to be heard concerning the proposed m arketing agreement and the proposed order; and Whereas, the Secretary finds upon the evidence introduced at the hearing and the record thereof;
1 That, in order to give such hops a purchasing power with respect to articles that farmers buy equivalent to the aver age purchasing power of such hops dur ing the aforesaid base period, the aver age price received by the grower o f such hops should have been approximately 31.4 cents per pound of hops during the 1937-38 marketing season;
2 That the average price received by growers o f such hops fo r the 1937-38
marketing season was 16.7 cents per pound of hops;
3 That the average price per pound of said hops received by growers during the period from 1928 to 1937 was sub stantially less than the purchasing power o f such hops during the aforesaid base period;
4 That, in the past, the lack of regulation o f the shipment of hops pro duced in the aforesaid States o f Oregon, California, and Washington was an im
portant factor contributing toward un stable marketing conditions fo r such hops and consequently depressed prices to growers;
5 That the regulation o f shipments o f hops by proration, as provided in article IV of this order, subject to the terms and provisions contained in this order, w ill tend to prevent fluctuation o f prices to growers, and thereby establish and maintain a more stable market for said hops, tending to restore prices to growers o f said hops to a level that w ill have a purchasing power with respect to articles that producers buy equivalent to the purchasing power of said hops in the aforesaid base period;
6 That the method o f regulating shipments by proration among handlers, as provided in this order, is fa ir and equitable;
