WHEREAS section 5 of the joint resolution of Congress approved May 1, 1937, amending the join t resolution en titled Joint resolution providing fo r the prohibition o f the export of arms, ammunition, and implements of war to belligerent countries; the prohibition of the transportation of arms, ammunition, and implements of war by vessels of the United States fo r the use of belligerent states; fo r the registration and licensing of persons engaged in the busi ness of manufacturing, exporting, or im porting arms, am munition, or implements of war; and restricting travel by American citizens on belligerent ships during war , ap proved August 31, 1935, as amended February 29, 1936, provides in part as follow s:
The President is hereby authorized to proclaim upon recommendation of the Board from tim e tb time a list of articles which shall be considered arms, ammunition, and implements of war fo r the purposes of this section.
NOW, THEREFORE, I, F R A N K LIN D. ROOSEVELT, President of the United States of America, acting under and by virtue o f the authority conferred upon me by the said joint resolution of Congress, and pursuant to the recommen dation of the National Munitions Control Board, declare and proclaim that the articles listed below shall, on and after June T, 1937, be considered arms, ammunition, and imple ments of war fo r the purposes of section 5 o f the said join t resolution of Congress:
Category I
1 Rifles and carbines using ammunition in excess of caliber .22, and barrels fo r those weapons;
2 Machine guns, automatic or autoloading rifles, and machine pistols using ammunition in excess o f caliber .22, and barrels for those weapons;
3 Guns, howitzers, and mortars of all calibers, their mountings and barrels;
4 Ammunition in excess of caliber 22 fo r the arms enumerated under 1 and 2 above, and cartridge cases or bullets fo r such ammunition; filled and unfilled projectiles for the arms enumerated under 3 above;
5 Grenades, bombs, torpedoes, mines and depth charges, filled or unfilled, and apparatus fo r their use or discharge;
6 Tanks, m ilitary armored vehicles, and armored trains.

Vessels of war of all kinds, including aircraft carriers and submarines, and arm or plate fo r such vessels.
Category I I I
1 Aircraft, unassembled, assembled, or dismantled, both heavier and lighter than air, which are designed, adapted, and intended fo r aerial combat by the use of machine guns or of artillery or fo r the carrying and dropping o f bombs, or which are equipped with, or which by reason o f design or construction are prepared for, any o f the appliances re ferred to in paragraph 2 below;

This proclam ation shall supersede the proclam ation of A pril 10, 1936, entitled Enumeration of A rm s, A m m u n ition, and Implements of W ar , on June 1, 1937.
