NOTICE IS HEREBY GIVEN THAT A REAL PROPERTY
ACQUISITIONS AND DISPOSITIONS PUBLIC HEARING, in accordance with Section 824 of the New York City Charter, will be held, on December 19, 2018, at 10:00 A.M., in Conference Room B, 20th Floor, 1 Centre Street, Borough of Manhattan.
IN THE MATTER OF an amendment Amendment of the lease for The City of New York, as Tenant, of approximately 77,612 rentable square feet of space, comprising the entire building 1st, 2nd and 3rd floors, and 7,123 square feet of basement space of a building, located at 144-06 94th Avenue Block 9993, Lot 3, and an outdoor parking lot of 10,000 square feet, in the Borough of Queens, for the Department of Finance to use as office space, or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.
The proposed lease amendment, which has an effective date of October 15, 2018 Effective Date, shall i modify Article 6 of the existing lease Alterations and Improvements, in order to increase the Tenant Work Cost to $13,874,000 as such term is defined in the Amendment; b change the rental terms of the Lease as set forth in the next sentence;
iii reimburse the Landlord for certain architectural and engineering fees incurred in connection to changes to the plans for Tenant alterations to the space; and iv modify the Tenants right to terminate the Lease by changing the effective date of Tenants right to terminate to on or after October 15, 2028, upon 180 days notice and otherwise in accordance with the provisions the Amendment. The change in annual Base Rent shall be as follows: $1,819,717.50 for the period beginning December 14, 2014 and ending November 30, 2018; $2,134,593.50 for the period beginning December 1, 2018 and ending November 30, 2023;
$2,292,422.20, for the period beginning December 1, 2023 and ending November 30, 2028; and $2,449,469.50 for the period beginning December 1, 2028 and ending November 30, 2033, payable in equal monthly installments at the end of each month. The first months rent shall include a payment of $1,047,093.40 to Landlord, which amount is comprised of the following: i $1,218,314.60, which amount represents the difference between the rent paid, pursuant to the existing lease and the rent payable, pursuant to this Amendment from the period commencing on December 16, 2014 the date the parties agree that substantial completion of alterations under the exiting lease should have occurred through and including the Effective Date, plus ii $137,267.80, which amount represent the additional architectural and engineering fees payable to Landlord in accordance with Paragraph 6 of the Amendment, less $308,489.00, which amount represents a rent credit owed to Tenant in connection with an lease audit as more particularly described in Paragraph 7 of the Amendment.
All other terms and conditions of the Lease shall remain the same.
