D esignation of the A ssistant S ecretaries of C ommerce and th e S olicitor of Commerce to act as Secretary of C om
merce
By virtue of the authority vested in me by section 179 of the Revised Statutes of the United States 5 U. S. C. 6 , I hereby authorize and direct the. Assistant Secre taries of Commerce, the date of their commissions to govern the order of prece dence, to perform the duties of the Sec retary of Commerce in case of the ab sence, sickness, resignation, or death of the Secretary of Commerce and of the Under Secretary of Commerce ; and I
also authorize and direct the Solicitor of Commerce to perform the duties of the Secretary of Commerce in ease of the absence, sickness, resignation, or death of the Secretary of Commerce, the Under Secretary of Commerce, and the AssistantSecretaries of Commerce.
This order supersedes Executive Order No. 8541 of September 17, 1940, entitled Designation of the Aistant Secretary of Commerce and the Solicitor of Com merce To Act as Secretary of Commerce.

Paragraph a of 6.3, Landing re quirements, of Title 19, Code of Federal Regulations, also designated as 116.3
of Title 8 and 11.503 of Title, 42, is amended by deleting the second sen tence and substituting the following:
a Place of landing. The first landing shall be at an airport of
entry unless permission to land else where shall first be granted by the Com missioner of Customs, in the case of air craft operated by scheduled air lings, and in all other cases by the collector or deputy collector of customs at the port of entry nearest the intended place of landing. When the Commissioner of Customs grants permission to land else where than at an airport of entry, he shall immediately notify the heads of the Public Health Service, the" Immigra tion and Naturalization Service, and of any other agency likely to be concerned with the landing, and, when a collector or deputy collector of customs grants such permission, he shall immediately notify the principal local officer of each such agency.
Effective date. This amendment shall become effective upon the date of its publication in the F ederal R egister.
Compliance with the provisions of sec tion 4 of the Administrative Procedure Act 60 Stat. 238 with respect to notice and public procedure thereon and de layed effective date is found to be un necessary and contrary to the public in terest because the amendment will facilitate air commerce and lessen the requirements and restrictions on affected persons.
