SERVICE TO BE CREDITED

Section 26.231 Service to he credited 11 F. R. 7394, 9547, 11349 is amended by the addition of a paragraph as fol lows:
h > In the case of an employee who applied for restoration, reappointment or reemployment within the period, pro vided by statute or regulation, of 90 cal endar days after honorable discharge from the military service or from hos pitalization continuing for a period of not more than one year after such dis charge, and who has been restored, re appointed or reemployed as a result of such application, the total period of time elapsing between the termination of military service or release from hos pitalization continuing thereafter, and entrance on duty in his civilian position if such period does not exceed 120 cal endar days. However, if entrance on civilian duty has been delayed so that such period is in excess of 120 calendar days, only the first 120 calendar days of such period may be credited. This para graph shall be effective December 5,1946
and shall apply to all computations of within-grade salary increases made after that date.
N ote : Under the present regulations credit tow ard w ith in-grad e salary advancements is n o t allowed fo r so m uch o f th e period o f tim e between th e date o f honorable dis charge fro m th e m ilitary service or fro m h osp italization con tinu in g fo r a period o f n o t more than one year after such discharge and the date o f restoration, reappointm ent or reem ploym ent to a civilia n position, as exceeds in to ta l th e equivalent o f tw en tytw o eigh t-h our days in the basic fo rty-h o u r workweeks w ith in th e period o f service re
quired fo r one periodic w ith in -grad e ad va n cem en t. T h is am endm ent extends th e period for which credit m ay be given to 120

tiv e date o f this am endm ent to th irty days a fte r publication in th e F ederal R egister, as required b y section 4 c o f th e Adm inis tra tiv e Procedure A c t Pub. Law 404, 79th Cong., 2d sess., w ould in some cases require th e postponem ent o f w ith in-grade salary ad vancem ents to employees w h o w ould be eligible fo r such advancements under this am endm ent.
T h e Commission th erefore finds th a t there exists good cause fo r m aking such am endm ent effective im m ediately.
