Whereas, the Agricultural Adjustment Act of 1938, as amended, provides:
Sec. 334 a The national acreage allot ment for wheat shall be apportioned by the Secretary among the several States on the basis of the acreage seeded for the produc tion of wheat during the ten calendar years immediately preceding the calendar year in which the national acreage allotment is de termined plus, in applicable years, the acre age diverted under previous agricultural ad justment and conservation program s, with adjustments for abnormal weather condi tions and for trends in acreage during such period.

Whereas, said Act provides, in Section 301 c , that The latest available sta tistics of the Federal Government shall be used by the Secretary o f Agricul ture in making the determinations re quired to be made by the Secretary under this Act ;
By virtue of the authority vested in the Secretary of Agriculture by the above-quoted sections of the Agricultur al Adjustment Act of 1938, as amended, upon the basis of latest available statis tics of the Federal Government, the national acreage allotment for wheat for 1940, as established by the procla mation dated May 16, 1939,1 is hereby apportioned among the several States as follows:
