BY THE PRESIDENT OF THE UNITED STATES
OF AMERICA
A PROCLAMATION

WHEREAS the Act of August 18, 1942, Public Law 704, 77th Congress, contains in part the following provisions:
"Be it enacted by the Senate and House of Representatives of the JJnited States of America in Congress assembled , T h at th e district courts sh a ll have original ju risd iction of all prizes captured during th e present war on the high seas if said capture was m ade by authority o f th e U n ited S ta tes or was adopted and ratified by th e P resid en t of th e United S ta tes and th e prize was brought in to the territorial w aters of a cobelligerent or was taken or appropriated for th e u se of the U nited S ta tes o n th e h igh seas or in such territorial waters, in clu d in g jurisd ic tion of all proceedings for th e con d em nation of such property taken as prize.

"Sec . 3. The jurisdiction of prizes brought
in to th e territorial w aters of a cobelligerent shall n o t be exercised un d er au th ority of th is Act, nor sh a ll prizes be tak en or appro priated w ith in su ch territorial w aters for th e use o f th e U n ited States, u n less th e govern m en t having Jurisdiction over su ch territorial waters co n sen ts to th e exercise Of su ch juris diction or to su ch takin g or appropriation.

"Sec . 7. A cobelligerent of th e U n ited States w hich con sents to th e exercise of th e jurisdiction-herein conferred w ith respect to prizes of the U n ited S tates brought in to Its territorial w aters and t o th e takin g or appro priation of su ch prizes w ith in its territorial waters for th e use of th e U n ited S tates shall be accorded, upon proclam ation by th e Presi dent of th e U n ited States, lik e privileges w ith respect to prizes captured under au th ority of such cobelligerent and brought in to th e territorial waters o f th e U n ited S tates or taken or appropriated in th e territorial waters of the U nited S ta tes for th e u se of su ch cobelligerent. Reciprocal recogn ition and full faith and credit sh a ll be given to th e jurisdiction acquired by courts of a cobelliger ent hereunder and to all proceedings had or judgm ents rendered in exercise of su ch jurisdiction.

WHEREAS the Government of New Zealand, a cobelligerent, has consented to the exercise of the jurisdiction con
ferred by the said Act with respect to prices of the United States brought into the territorial waters of the Dominion of New Zealand and its dependencies and to the taking or appropriation of such prizes within the territorial waters of the Dominion of New Zealand and its dependencies for the use of the United States:
NOW, THEREFORE, I, FRANKLIN D.
ROOSEVELT, President of the United States of America, acting under and by virtue of the authority vested in me by the said Act of August 18, 1942, do pro claim that the Government of the Do minion of New Zealand shall be ac corded like privileges withrespect to prizes captured under authority of the said Government and brought into the territorial waters of the United States or taken or appropriated in the terri torial waters of the United States for the use of the said Government.
IN WITNESS WHEREOF, I have heseunto set my hand and caused the seal of the United States of America to be affixed.
