WAGE RATES FOR PERSONS EMPLOYED IN
THE PRODUCTION AND CULTIVATION OF
SUGARCANE IN THE MAINLAND CANE SUGAR
ABTA DURING THE CALENDAR YEAR 1940
Whereas, Section 301 b of the Sugar Act of 1937 provides, as one of the con ditions for payment to producers of sugar beets and sugarcane, as follows:
b That all persons employed on the farm In the production, cultivation, or har vesting of sugar beets or sugarcane w ith re spect to which an application for paym ent is made shall have been paid in fu ll for all such work, and shall have been paid wages therefor at rates n ot less th an those th at may be determined by th e Secretary to be fair and reasonable after investigation and due notice and opportunity for public hear ing; and in making such determ inations the Secretary shall take into consideration the standards therefor formerly established by him under the Agricultural Adjustm ent Act, as amended, and the differences in condi tions among various producing areas: Pro vided, however, That a paym ent which would be payable except for th e foregoing provisions of this subsection may be made, as the Secretary may determine, in such manner that the laborer will receive an amount, insofar as such paym ent will suffice, equal to the amount of th e accrued unpaid wages for such work, and th a t th e pro ducer will receive th e remainder, if any, of such payment.
And whereas, The Secretary of Agricul ture has held a number of public hear t s 1 in the mainland cane sugar area for the purpose of receiving evidence likely to be of assistance to him in de termining fair and reasonable wage rates for persons employed in the production and cultivation of sugarcane during the Period from January 1, 1940, to Decem ber 31, 1940.
Now, therefore, I, H. A. Wallace, Secretary of Agriculture, after investiga tion and due consideration of the evi dence obtained at the aforesaid hearings 4 F.R. 2281.
