I t is further ordered, That W. McNeil Kennedy or any other officer or officers of the Commission designated by it for that purpose shall preside at the hear ings in such matter. The officer so desig nated to preside at any such hearing is hereby authorized to exercise all powers granted to the Commission under section 18 c of said Act and to a trial exam iner under the Commissions Rules of Practice to continue or postpone said hearing from time to time.
Notice of such hearing is hereby given to such declarant or applicant and to any other person whose participation in such proceeding may be in the public interest or for the protection of investors or consumers. I t is requested that any person desiring to be heard or to be admitted as a party to such proceeding shall file a notice to that effect with the Commission on or before January 14, 1939.
The matter concerned herewith is in regard to an application filed by Jay Samuel Hartt, Trustee of the Estate of Midland Utilities Company, now in re organization under Section 77B of the Bankruptcy Act as amended, pending in the District Court o f the United States for the District of Delaware No. 1073 , requesting approval by the Commission of $2,500 per month as the maximum amount which may be reasonably paid, on account, to said Jay Samuel Hartt for services rendered by him from Oc tober 24, 1938, as Trustee of the Estate of Midland Utilities Company, plus re imbursement for his necessary expenses incurred from time to time as such Trustee.
The applicant further requests an ex emption from the provisions of Rule U-11F-2 with respect to the payment of compensation for services to be rendered by him, as Trustee, in the future, such exemption to be for the sum of $2,500
per month plus reimbursement for his necessary expenses incurred from time to time as Trustee.
The applicant further requests an ex emption from the provisions of Rule U-11F-2 with respect to the paymeht of compensation for the services of Elbridge Lennon Lord as an accountant, and Donald M. Cook as an engineer, such exemption to be for the sum of $600 per

Im portant. Although the apportioned classified civil service is by law located only in Washington, D. C it neverthe less includes only about half of the Fed eral Civilian positions in the District of Columbia. Positions in local post of fices, customs districts, and other field services outside of the District of Colum bia which are subject to the Civil Serv ice Act are filled almost wholly by per sons who are local residents of the gen eral community in which the vacancies exist. It should be noted and under stood that so long as a person occupies, by original appointment, a position in the apportioned service, the charge for his appointment continues to run against his State of original residence.
