Proposed Amendments to the Regulations

The Council on Environmental Quality CEQ is proposing to modify certain aspects of its regulations for implementing the procedural provisions of the National Environmental Policy Act NEPA to generally restore regulatory provisions that were in effect for decades before being modified in 2020. CEQ proposes these changes in order to better align the provisions with CEQs extensive experience implementing NEPA, in particular its perspective on how NEPA
can best inform agency decision making, as well as longstanding Federal agency experience and practice, NEPAs statutory text and purpose, including making decisions informed by science, and case law interpreting NEPAs requirements. The proposed rule would restore provisions addressing the purpose and need of a proposed action, agency NEPA procedures for implementing CEQs NEPA regulations, and the definition of effects. CEQ
invites comments on the proposed revisions.

SUPPLEMENTARY INFORMATION:
I. Background On January 1, 1970, President Nixon signed into law the National Environmental Policy Act of 1969
NEPA, 42 U.S.C. 4321 et seq. Congress enacted NEPA by a unanimous vote in the Senate and a nearly unanimous vote in the House 1 to declare a national policy to promote environmental protection for present and future generations. NEPA was established to encourage productive and enjoyable harmony between humans and the environment; to promote efforts that will prevent or eliminate damage to the environment and biosphere and stimulate the health and welfare of people; and to enrich the understanding of the ecological systems and natural resources important to the Nation. 42

To achieve these objectives, NEPA
