On June 22, 1956, a notice of proposed rule making was published in the F e d
eral
R egister
21 F. R. 4413 regarding
proposed amendments to the United States Standards for Grades o f Canned Sweet Cherries 7 CFR, 52.821 to
52.836.
After consideration o f all relevant matters presented, including the pro posed amendments set forth in the aforesaid notice, the following amend ments to the United States Standards for Grades of Canned Sweet Cherries are hereby promulgated pursuant to the authority contained in theAgricultural Marketing Act of 1946 60 Stat. 1087 et seq-, as amended, 7 U. S.C. 1621 et seq. :
The amendments to 52.833 are as
follows:
1. Change paragraph a to read:
52.833 Absence of d e f e c t s a General. The factor o f absence of de fects refers to the degree of freedom from harmless extraneous material;
from portions of stems ; from pits o r Portions thereof in pitted style; from jmghtly damaged, damaged, seriously maged, slightly misshapen, misshapen, wemished, and seriously blemished cuernes; and from any other defects mch detract from the appearance or sumlity of the product. Processing cracks are not considered as defects but re considered under the factor of aracter. 52.834.
. Compliance with the provisions o f these gu a rd s shall not excuse failure to comply a the provisions o f the Federal Food, and Cosmetic Act.
2. Change paragraphs, a 5 and 6
to read:

5 Slightly damaged means any injury other than blemishes which affects the appearance of the cherry, and in cludes:
i Circular cracks with slight dis coloration, such as rain checks, con fined entirely within the stem basin and more than % inch, but not more than y2 inch, in length;
ii Cracks with slight discoloration, such as rain checks outside the stem basin and more than % q inch, but not more than % inch in length;
iii Mutilated cherries in unpitted style whereby the cherry is seriously torn at the stem and that such torn area ex ceeds that o f a circle 4 inch in diameter;
and mutilated cherries in pitted style whereby the cherry is so pitter-tom or so damaged by other similar means that the entire pit cavity is exposed and the appearance o the cherry is seriously affected.
6 Damaged means any injury other than blemishes which materially affects the appearance of the cherry and includes:
i Circular cracks with discoloration, such as rain checks, confined entirely within the stem basin and m ofe than % inch in length;
ii Cracks with discoloration, such as rain checks, outside the stem basin and more than % inch in length;
3. Insert new paragraph a read:

7 Seriously damaged means dam aged to the extent that the appearance or edibility of the cherry is seriously affected.
4. In paragraph a , renumber subparagraphs as follows: Change 7 to 8, 8 to 9 , 9 to 10, and 10
to 11.
5. Change paragraph b 4> to read:
