By virtue of the authority vested in me by section 301 of title 3 o f the United States Code, section 1 of Executive Order No. i0524 of March 31, 1954, delegating certain functions of the President re specting school-construction assistance, is hereby amended to read as follows:
S e c t io n 1. The Secretary of Health, Education, and W elfare ishereby au thorized and empowered, without the approval, ratification, or other action of,th e President, to make the findings authorized to be made by the President under section 305 a, 3 of the act of September 23, 1950, entitled An Act re lating to the construction of school facilities in areas affected by Federal activities, and for other purposes , as heretofore or hereafter amended 20

AND REPORTS, ENFORCEMENT
Basis and purpose. Section 376, Title HI, of th Agricultural Adjustment Act of 1938, as amended, provides that the 119 F. R. 1809.
several district courts of the United States are vested with jurisdiction spe cifically to enforce the provisions of such title; and further, that if and when the Secretary shall so -request, it shall be the duty of the several district attorneys in their respective districts, under the di rection of the Attorney General, to in stitute proceedings to collect the penal ties provided under such title. Sections 722.575 and 722.582 of the Marketing Quota Regulations for the 1954 Crop of Upland Cotton 19 F. R. 3124 provide that, with respect to cases of failure or refusal to pay or remit penalties or of failure or rfusal to make any report or keep any record, it shall be the duty of the State committee to report each such case in writing to the Director of the Cotton Division with a view to the insti tution of proceedings to collect the pen alties due or to enforce the provisions of the act.
- The purpose of the amendments con tained herein is to provide that it shall be the duty of the State committee to report such cases to the Office of the Solicitor of the United States Department o f A g riculture, in accordance with instruc tions issued by the Deputy Administra to r for Production Adjustment, with a view to the institution of proceedings to collect the penalties due or to enforce the provisiofas of the act.

3124, is hereby changed to read as fo l lows:
722.575 Report of violations and court proceedings to collect penalty. It shall be the duty of the county commit tee to report in writing to the State committee each case of failure or refusal to pay the penalty or to remit the same as provided in 722.542 to 722.586 to the Secretary when collected. I t shall be the duty of the State Committee to report each such case in writing to the Office of the Solicitor of the United States Department of Agriculture, in accord ance with instructions issued by the Deputy Administrator for Production Ad justment, with a view to the institution of proceedings by the United States A t torney for the appropriate district, under Continued on next page
