BY THE PRESIDENT OF THE UNITED STATES OF
AMERICA
A PROCLAMATION
WHEREAS section 6 of the act of Con gress entitled AN ACT To expedite the strengthening of the national defense, approved July 2,1940, provides as follows:
S e c . 6. W henever th e President determ ines th a t it is necessary in th e interest of national defense to prohibit or cu rtail th e exportation of any m ilitary equipm ent or m unitions, or component p a rts thereof, or m achinery, tools, or m aterial or supplies necessary for th e m anufacture, servicing or operation thereof, he may by proclam ation pro h ib it or curtail such exportation, except un d er such rules and regulations as he shall prescribe. Any such proclam ation shall describe th e articles or m aterials included in th e prohibition or curtailm ent contained therein. In case of the violation of any provision of any proc lam ation, or of any rule or regulation, issued hereunder, such violator or violators, upon conviction, shall be punished by a fine of n o t more th a n $10,000, or by im prisonm ent for n o t more th a n two years or by both such fine and im prisonm ent. T he au th o rity granted in th is Act shall te rm in ate Ju n e 30, 1942, unless th e Congress shall otherwise provide.
AND WHEREAS the joint resolution of Congress approved May 28, 1941 provides as follows:
T h at th e provisions of section 6 of th e Act of Congress e n title d An Act to ex pedite th e stre n g th e n in g of th e n atio n al de fense, approved Ju ly 2, 1940 54 S ta t. 714, shall be applicable to all Territories, de pendencies, and possessions of th e U nited States, including th e Philippine Islands, th e Canal Zone, and th e D istrict of Columbia, and th e several courts of first instan ce of the Com m onw ealth of th e Philippine Islands shall have jurisdiction of offenses com m itted in the Philippine Islands in violation of th e provisions of th a t section or of any proclam a tion, or of any ru le or any regulation, issued thereunder.
NOW, THEREFORE, I, FRANKLIN D.
ROOSEVELT, President of the United States of America, acting under and by virtue of the authority vested in me by the said act of Congress and the said joint resolution, do hereby proclaim that upon the recommendation of the Admin istrator of Export Control I have de termined that it is necessary in the in terests of the national defense that on and after this date the articles and m a terials described in the proclamations heretofore issued pursuant to the said section 6 shall not be exported from the Territories, dependencies, and posses sions of the United States, including the Philippine Islands, the Canal Zone, and the District of Columbia, except when authorized in each case by license. For all Territories, dependencies, and pos sessions of the United States, including the Philippine Islands, the Canal Zone, and the District of Columbia, licenses shall be issued in accordance with Proclamations 24131 of July 2, 1940 and 24652 of March 4, 1941, and the rules and regulations prescribed by Executive Orders 8712 s and 87134 of March 15, 1941, as they may be from time to time amended.
IN WITNESS WHEREOF, I have here unto set my hand and caused the seal of the United States of America to be affixed.
DONE at the city of Washington this 28th day of May, in the year of our Lord nineteen hundred and forty seal one, and of the Independence of the United States of America the one hundred and sixty-fifth.
