MARKETING YEAR

In prder to reflect a revision in the re port of ballots cast in Orleans Parish, Louisiana, and to correct the section number so as to read 722.303 instead of 722.302, the second paragraph of the proclamation1 issued by the Secretary of Agriculture on December 31, 1940, an nouncing the results of the referendum held on December 7,1940, on cotton mar keting quotas for the marketing year 194,1-42, is hereby amended to read as follows:
722.303 Results of cotton referen dum. a In the referendum of farmers who were engaged in production of the 1940 crop of cotton, conducted by the Secretary of Agriculture on December 7, 1940, to determine whether such farm ers were in favor of or opposed to mar keting quotas for cotton for the market ing year beginning August 1, 1941, the total number of votes cast was 918,857
and of the total number of votes so cast 848,428 votes, or 92.3 percent, were in favor of, and 70,429 votes, or 7.7 percent, were opposed to, such marketing quotas.

Whereas section 301 b of the Sugar Act of 1937, as amended, provides the following as one of the conditions for payment to producers of sugar beets and sugarcane:
T h a t all persons employed on th e farm in th e production, cultivation, or harvesting of sugar beets or sugarcane w ith respect to w hich a n application for paym ent is m ade shall have been paid in full for all such work, and shall have been paid wages therefor a t rates n o t less th a n those th a t may be de term ined by th e Secretary to be fair and reasonable a fter investigation and due notice and opportunity for public hearing; and in m aking such determ inations th e Secretary shall take in to consideration th e standards therefor form erly established by him under th e A gricultural A djustm ent Act, a s amended, and th e differences in conditions am ong vari ous producing a reas: Provided, however, T h at a paym ent w hich would be payable except fo r th e foregoing provisions of th is subsec tion m ay be made, as th e Secretary m ay de term ine, in such m anner t h a t th e laborer will receive a n am ount, insofar as such pay m en t will suffice, equal to th e am ount of th e accrued unp aid wages for such work, and th a t th e producer will receive th e rem ainder, if any, of such paym ent;

And whereas the Secretary of Agricul ture, conformably to said section 301 b, has held a public hearing in Hawaii for the purpose of receiving evidence likely to be of assistance to hifti in determining fair and reasonable wage rates for per sons employed in the production, cultiva tion, - or harvesting of sugarcane in Hawaii during the period January 1, 1941, through December 31, .1941;
Now, therefore, I, Claude R. Wickard, Secretary of Agriculture, after investiga tion and due consideration of the evi dence obtained at the aforesaid hearing and all other information before me, do hereby make the following determina tion:
