Whereas, section 6 of article VII, para graphs 1 and 2 of Order No. 271 regu lating the handling of milk in the New York Metropolitan Marketing Area pro vides that:
The market administrator shall pay out of the producer settlement fund to any handler immediately after audit of claim for such payment made on forms supplied by the market admin istrator:
1. W ith respect to milk received from producers at a plant operated by such handler equipped only for the receiving and shipping of milk to the marketing area, which was, during any month ex cept November or December, moved to a plant where it was utilized in Classes II-A , II-B , IH -A , H I-B , IH -C , IH -D , or, during the month of O c t o b e r , IV-A, and from which, if operated by such handler, no Class I milk was shipped to the marketing area during such month, 23 cents per hundredweight of milk so moved, plus 4 cents per hun dredweight for the first five miles or fraction thereof, plus lA cent per hun dredweight per mile for the next 20
miles, and plus l/10th of 1 cent per hundredweight per additional mile, of the shortest highway distance between the two plants; and 2. Thirty cents per hundredweight of Class I milk sold during the months of November and December in the market13 P.R. 1945 DI.
