By the President o f the United States o f America A PROCLAMATION
W HEREAS Senate Concurrent Resolution 5, 75th Con gress, 1st Session, provides:
"T h a t April 6 o f each year be recognized by the Senate and House of Representatives o f the United States of Am erica as Arm y Day, and that the President of the United States be requested, as Commander in Chief, to order m ilitary units throughout the United States to assist civil bodies in appropriate celebration to such extent as he may deem advisable; to issue a proclamation each year declaring A p ril 6 as Arm y Day, and in such procla mations to invite the Governors of the various States to issue Arm y Day proclamations: Provided, That in the event April 6 falls on Sunday, the follow ing Monday shall be recognized as Arm y Day.
NOW , TH EREFO RE, I, F R A N K LIN D. ROOSEVELT, President o f the United States o f America, pursuant to the above Concurrent Resolution, do hereby declare April 6, 1937, Arm y Day, and I invite the Governors of the several States to issue Arm y Day proclamations; and, acting under the authority vested in me as Commander in Chief, I order m ilitary units throughout the United States, its Territories and possessions, to assist civic bodies in the appropriate observance o f that day.
IN W ITNESS W HEREOF, I have hereunto set my hand and caused the seal o f the United States o f Am erica to be affixed.

A rticle 4, paragraph Ch, page 166 o f the July, 1936, Postal Guide, provides that indemnity w ill not be paid on account of damage to articles which are so fragile in their inherent nature as to prevent their safe carriage in the mails, regard less of the manner in which packed.
Owing to the extrem ely fragile nature of gaseous tubes fo r signs or outline lighting, commonly known as neon signs, indemnity w ill not be paid on account o f damage which may occur to such articles shipped as domestic insured or C. O. D. mail, unless it is definitely established th at the damage was due to rough treatm ent in the mails. In other words, favorable consideration w ill not be given to the payment o f indem nity on account o f damage to such articles m erely because they are received in damaged condition by the addressee, unless the containers in which shipped were actually broken in the mails or it is otherwise definitely established that the parcels were mistreated while in the custody of th e Postal Service. Postmasters are requested to appropriately advise patrons m ailing articles o f this char acter as insured or C. O. D. mail.
