DETERMINATION WITH RESPECT TO TYPES OF
PEANUTS IN INSUFFICIENT SUPPLY FOR
1953-54 MARKETING YEAR
The purpose of this proclamation is to establish th at the supply of Valencia type peanuts for the marketing year be ginning August 1, 1953, will be insuffi cient to meet the estimated demand for cleaning and shelling purposes, to estab lish the extent of increase in State al lotments for States producing Valencia type peanuts required to meet such de mand, and to apportion such increase to such States. These determinations are made pursuant to section 358 c of the Agricultural Adjustment Act of 1938, as amended 7 U. S. C. 1358 c, which reads in part as follows :
Notwithstanding any other provision of law, if the Secretary of Agriculture deter mines, on the basis of the average yield per acre of peanuts by types during th e preceding five years, adjusted for trends in yields and abnormal conditions of production affecting yields in such five years, that th e supply of any type or types of peanuts for any mar keting year, beginning w ith th e 1951-52 mar
keting year, will be insufficient to m eet the estimated demand for cleaning and shelling purposes at prices w hich th e Commodity Credit Corporation m ay sell for su ch pur poses peanuts owned or controlled by it, the State allotm ents for those States pro ducing such type or types of peanuts shall
be increased to th e extent determ ined by th e Secretary to be required to m eet su ch de mand but th e allotm ent for any State may nt be increased under th is provision above the 1947 harvested acreage of peanuts for such State. The total increase so determ ined 8hall be apportioned among such States for distribution among farms producing peanuts of such type or types on th e basis of th e erage acreage of peanuts of su ch type or types in th e three years im m ediately pre ceding the year for w hich th e allotm ents are being determined. The additional acreage so required shall be in addition to th e n a
tional acreage allotm ent, th e production from such acreage shall be in addition to th e
national marketing quota, and the increase in acreage allotted under th is provision shall n ot be considered in establishing future State, county, or farm acreage allotm ents.
Section 729.405 of this proclamation defines each of the four commonly known basic types of peanutsRunner, Spanish, Valencia, and Virginiaby describing the outstanding physical characteristics of each type and the areas of the United States in which each is most commonly grown. The definition of Virginia type peanuts includes a requirement th at each lot or load of peanuts having Virginia type characteristics must contain a min imum percentage of large, so-called Fancy, size peanuts, otherwise such lot or load will be considered Runner type peanuts.
Section 729.406 establishes the type of peanuts for which the supply for the marketing year beginning August 1, 1953, will be insufficient to meet the estimated demand for cleaning and shelling purposes a t prices at which Commodity Credit Corporation may sell for such purposes peanuts owned or con trolled by it. This determination is based on the estimated production of each type of peanuts from the State allotments previously announced for the 1953 crop, on the basis of the average yield per acre of peanuts by types in the five years 1948-1952, adjusted for trends in yields and for abnormal conditions of production affecting yields in those years. Section 729.406 also establishes the total increase in State allotments required to meet the prescribed demand for Valencia type peanuts.
Section 729.407 apportions the in crease determined under 729.406 to States producing Valencia type peanuts.
Such increase is prorated to such States on the basis of the average acreage of Valencia type peanuts excluding acreage in excess of farm allotments grown in each State in the three years 1950-1952, but the allotment for no State is increased above the 1947 h a r vested acreage of peanuts for the State.
