Chapter I Immigration and Natural ization Service, Department of Jus tice Subchapter B Immigration Regulations P art 116 CI vil A ir N avigation LIEN AND SEIZURE OF AIRCRAFT

Reference is made to the notice of proposed rule m aking which was pub lished in the F ederal R egister of Sep tember 20,1951 16 F. R. 9573, pursuant to section 4 of the Administrative Proce dure Act 60 Stat. 238; 5 U. S. C, 1003
and in which there were stated in full the terms of a proposed amendment of the rules relating to seizure of aircraft by immigration officers. No representa tions have been received concerning the proposed amendment.
The rule, as stated below, is hereby adopted. The provisions of the adopted rule are the same as those stated in the notice of proposed rule making.
The following amendments to 116.60, Penalties, of Chapter I, Title 8 of the Code of Federal Regulations, are hereby prescribed:
1. The second sentence of paragraph c is amended to read as follows: I f the deposit of the amount of the pro posed penalty is not made with the col lector of customs or acceptable bond is not furnished providing fo r the payment of such penalty, or so much thereof as may not be remitted or mitigated by the Attorney General, clearance of the a ir craft shall be withheld by the collector of customs, and in case the violation is by the owner or person in command of the aircraft and is subject to the civil penalty of $500 authorized by section 11
b of the A ir Commerce Act of 1926, as amended, the penalty shall be a lien against the aircraft, which shall be seized by the immigration officer in charge of the district or immigrant inspector des ignated by him, and placed in the cus tody of the customs officer in charge at the port of entry or customs station nearest the place of seizure.
2. The third sentence of paragraph c is deleted.

The rule stated above shall become effective on the thirty-first day following its. publication with this order in the F ederal R egister .
The general basis for the rule is the determination that it is advantageous to the Government that aircraft be seized as expeditiously as possible in those in stances in which the civil penalty a u
thorized by the A ir Commerce Act of 1926, as amended, is a lien against the aircraft. The purpose of the rule is to specifically designate the immigration officers who shall have authority to make such seizures.
