Determination of fair and reasonable wage rates for persons employed in the production, cultivation, or harvesting of sugarcane in the Virgin Islands during the calendar year 1942.
Whereas section 301 b of the Sugar Act of 1937, as amended, provides, as one of the conditions for payment to pro ducers of sugar beets and sugarcane, as follows: H :>4.
That all persons em ployed on th e farm in the production, cu ltiv a tio n , or h arvestin g of sugar beets or sugarcane w ith respect to which an ap plication for p aym ent is m ade shall have been paid in fu ll for all such work, and shall have been paid wages th ere for at rates n o t less th a n th ose th a t m ay be determ ined by th e Secretary to be fair and reasonable after in v estig a tio n and due notice and opportunity for pu b lic hearing;
and in m aking su ch d eterm in ation s th e Secretary shall take in to consideration th e standards therefor form erly estab lish ed by him under th e A gricultural A d justm en t Act, as amended, and th e differences in con d ition s among various producing areas; P rovided, however, T hat a p aym ent w h ich would be payable except for th e foregoing provisions of this subsection m ay be m ade, as th e Sec retary may determ ine, in such m ann er th a t the laborer w ill receive an am ount, insofar as such paym ent w ill suffice, equal to th e amount of th e accrued unp aid wages for such work, and th a t th e producer w ill receive the remainder, if any, of such paym ents;
and Whereas the Secretary of Agriculture, on March 26, 1942, held a public hearing in Christiansted, St. Croix, Virgin Islands, for the purpose of receiving evi dence likely to be of assistance to him in determining fair and reasonable wage rates for persons employed in the pro duction, cultivation, or harvesting of sugarcane in the Virgin Islands during 1942.
Now, therefore, I, Paul H. Appleby, Under Secretary of Agriculture, after in vestigation and due consideration of the evidence obtained at the aforesaid hear ing and all other information before me, do hereby make the following determina tion:
