Secretary, on the 31st day of December 1940, and Whereas said Act contains, in section 301 b , the following definitions of terms here pertinent:
Total supply o f tobacco fo r any market ing year shall be th e carry-over at the be ginning o f such m arketing year plus the estimated production thereof in th e United States during the calendar year in which such marketing year begins
Carry-over of tobacco for any marketing year shall be the qu an tity of such tobacco on hand in the United States at the begin ning o f such m arketing year, which was produced in the United States prior to the beginning o f the calendar year then current, except th at it shall n ot include any amount of such tobacco o f th e 1939 and 1940 crops which the Secretary determines is stored tem
porarily in the United States because o f war or other unusual conditions delaying the normal exportation thereof
Marketing year means, in th e case of the follow ing commodities, the period b egin
ning on the first and ending w ith the second date specified below :

Reserve supply level o f tobacco shall be the normal supply plus 5 per centum thereof, to insure a supply adequate to m eet domes tic consumption and export needs in years of drought, flood, or other adverse condi tions, as well as in years o f plenty.
The normal supply o f tobacco shall be a normal years domestic consumption and exports plus 175 per centum o f a normal years domestic consumption and 65 per centum of a normal years exports as an allowance for a normal carry-over.
Normal years domestic consumption , in the case of tobacco, shall be the yearly average qu an tity o f the com modity produced in the United States th at was con sumed in the United States during the ten marketing years im m ediately preceding th e marketing year in which such consumption is determined, adjusted fo r current trends in such consumption.
Normal years exports in the case of tobacco shall be the yearly average quantity o f the com m odity pro duced in the United States th at was exported from the United States during the ten mar keting years im m ediately preceding the m arketing year in which such exports are determined, adjusted for current trends in such exports.

And, whereas said Act provides, in sec tion 301 c , that The latest available statistics o f the Fed eral Government shall be used by the Secre tary o f Agriculture in m aking the determ i nations required to be made by the Secre tary under this Act.

Now, therefore, be it known that the Secretary of Agriculture of the United States of America, acting under and pur suant to, and by virtue of, the authority vested in him by the Agricultural A d justment Act of 1938, as amended, does hereby find, determine, specify, and pro claim that:

Whereas the Agricultural Adjustment Act o f 1938, as amended, provides:
S ec. 312 a Whenever the Secretary of Agricu ltu re finds th at the to ta l supply of tobacco as of the beginning o f th e m arketing year then current exceeds the reserve supply level therefor, the Secretary shall proclaim th e am ount o f such total supply, and, begin n in g on th e first day o f the m arketing year next follo w in g and continu ing throughout such year, a national m arketing quota shall be in effect for the tobacco marketed during such m arketing year. T he Secretary shall also determ ine and specify in such proclama tion the amount o f the national m arketing quota in terms o f the to tal qu an tity o f t o
bacco which may be marketed, which w ill make available during such m arketing year a supply o f tobacco equal to th e reserve supply level, Such proclamation shall be made n ot later than the 1st day o f December in such year. The am ount of th e national m arketing quota so proclaimed may, not later than December 31, be increased by not more than 20 per centum if the Secretary determ ines th at such increase is necessary in order to m eet market demands, or to avoid undue restriction o f marketings in adjusting the to tal supply to the reserve sup p ly level.

And whereas said Act, in Section 312
b , further provides:
