P art 29T he T obacco I nspection Act ORDER OF DESIGNATION OF TOBACCO MAR
KETS, VALDOSTA, GEORGIA, AND LIVE OAK, FLORIDA

Whereas, The Act of Congress ap proved August 23, 1935 49 Stat., 731:7
U.S.C., Sup. I, Chap. 21A entitled The Tobacco Inspection Act contains the following provisions:
Sec. 2 T hat transactions in tobacco involv ing the sales thereof a t auction as com monly conducted a t auction m arkets are affected w ith a public interest; th a t such transactions are carried on by tobacco pro ducers generally and by persons engaged in the business of buying and selling tobacco in commerce; th a t th e classification of to
bacco according to type, grade, and other characteristics affects th e prices received therefor by producers; th a t w ithout uniform standards of classification and inspection th e evaluation of tobacco is susceptible to specu lation, manipulation, and control, and u n
reasonable fluctuations in prices and quality determinations occur which are detrim ental to producers and persons handling tobacco In commerce; th a t such fluctuations consti tu te a burden upon commerce and m ake th e use of uniform standards of classification and inspection imperative for th e protec tion of producers and others engaged in commerce and th e public interest therein.
Sec. 25 T hat th e Secretary is authorized to designate those auction m arkets where to

Before any inarket is designated by th e Secretary under this section he shall determ ine by referen dum the desire of tobacco growers who sold tobacco a t auction on such m arket during the preceding m arketing season. The Sec retary may a t his discretion hold one reffor two or more m arkets or for all markets in a type area. No m arket or group or markets shall be designated by th e Sec retary unless tw o-thirds of th e growers votug favor it. The Secretary shall have ac cess to th e tobacco records of th e Collector o internal Revenue and of th e several collectore of internal revenue for th e purpose or obtaining th e names and addresses of mart-o? Whereas, pursuant to said Act refer endums have been held among the growers of flue-cured tobacco who sold tobacco at auction on the markets of Valdosta, Georgia, and Live Oak, Flor ida, during the last marketing season, in which referendums said growers were given an opportunity to vote for or against the designation as provided in Section 5 of said Act; and Whereas, more than two-thirds of the growers voting in said referendums and who sold tobacco at auction on said markets during the last marketing season voted in favor of said designa tion.

of The Tobacco Inspection Act and the affirmative results of the referendums conducted thereunder, the flue-cured tobacco markets of Valdosta, Georgia, and Live Oak, Florida, are designated
