amending Regulation EU No 965/2012 as regards helicopter emergency medical service operations Text with EEA relevance
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation EU 2018/1139 of the European Parliament and of the Council of 4 July 2018 on common rules in the field of civil aviation and establishing a European Union Aviation Safety Agency, and amending Regulations EC No 2111/2005, EC No 1008/2008, EU No 996/2010, EU No 376/2014 and Directives 2014/30/EU
and 2014/53/EU of the European Parliament and of the Council, and repealing Regulations EC No 552/2004 and EC
No 216/2008 of the European Parliament and of the Council and Council Regulation EEC No 3922/91 1, and in particular Article 271 and Article 311 thereof, Whereas:

Commission Regulation EU No 965/2012 2 lays down technical requirements and administrative procedures related to air operations, and among others, to helicopter emergency medical service HEMS operations. Such technical requirements and administrative procedures should be updated to ensure that they reflect the state of the art in developments and best practices in the air operations domain.

Helicopter emergency medical services are among the most challenging operations from a safety perspective because the mission often consists of a flight to a non-pre-surveyed site in any weather conditions and under time pressure to rescue people. Such operations should be regulated in such a way that they remain safe at all times.

Helicopter emergency non-medical rescue operations, which include mountain rescue operations, but not search and rescue of aircraft in distress, are equally challenging when carried out under the same conditions as those of helicopter emergency medical service operations. Therefore, when helicopter emergency non-medical rescue operations fall within the scope of Regulation EU 2018/1139, they should be regulated in the same way as helicopter emergency medical services.

On the basis of available data, the risk of accidents due to a degraded visual environment, including operations in bad weather and at night, as well as the risk of collision at an accident or a rescue site, should be further mitigated by means of requirements for equipment, standard operating procedures, and crew training.
