VISTO: El expediente Nº 0002-027417/2006 mediante el cual la Jefatura de Policía de la Provincia propone la promoción de Oficiales Superiores, a partir del 1º de enero de 2007.
Y CONSIDERANDO:
Que dichas propuestas se ajustan a lo resuelto por las Juntas de Promociones para Oficiales Superiores, aconsejándose el ascenso por las razones y fundamentos que obran en las actas labradas al efecto.
Que la Jefatura de Policía fundamenta la presente propuesta, expresando que, en los mismos se visualiza la idoneidad para el cumplimiento de los nuevos roles que su estamento jerárquico impone, para satisfacer las necesidades orgánicas de la Institución. Asimismo consigna, que los egresos correspondientes a la presente gestión serán atendidos con anticipo preventivo de ejercicio año 2007, según programa y partidas que el presupuesto autorice.
Que conforme a lo expuesto, se considera oportuno y conveniente la Promoción de los Oficiales Superiores en función de lo normado por el artículo 32º inciso f de la Ley Nº 9235/05 y lo establecido en el Capítulo Quinto 5º, Título II Régimen de Promociones Policiales de la Ley Nº 6702.
Por todo ello, lo dispuesto por el artículo 144º inciso 1º de la Constitución de la Provincia, las Leyes Nros. 9235, 6702 y modificatorias y complementarias, informes requeridos, lo dictaminado por la Asesoría Jurídica del Ministerio de Seguridad y por Fiscalía de Estado bajo Nros. 444/06 y 1244/06 respectivamente, y en ejercicio de sus atribuciones constitucionales, EL GOBERNADOR DE LA PROVINCIA
DECRETA:
ARTÍCULO 1º.- PROMUEVESE, a partir del 1º de enero de 2007, al personal policial, Oficiales Superiores, que se detalla en el Anexo Único de dos 2 fojas que se acompaña y forma parte del presente decreto.
ARTÍCULO 2º.- IMPÚTASE el egreso que demande lo dispuesto en el artículo precedente, a Anticipo Ejercicio 2007 y con el programa y las partidas específicas que fije el respectivo presupuesto y -en su méritoAUTORIZASE a la Dirección de Administración de la Policía de la Provincia a realizar la afectación y liquidación correspondiente para el cumplimiento de lo dispuesto en el presente decreto.
ARTÍCULO 3º.- AUTORIZASE al Ministerio Finanzas a efectuar las adecuaciones presupuestarias -Planta de Personal y Recursos Financierosemergentes de lo dispuesto en los artículos 1º y 2º de este decreto.
ARTÍCULO 4º.- El presente decreto será refrendado por el señor Ministro de Seguridad y por el señor Fiscal de Estado.
ARTÍCULO 5º.- PROTOCOLICESE, comuníquese a la Dirección General de Recursos Humanos de la Provincia, publíquese en el Boletín Oficial y archívese.
