ACTION: Final rule.
AGENCY:
On December 4, 2020, the Executive Office for Immigration Review EOIR published a notice of proposed rulemaking NPRM or proposed rule, proposing to amend EOIRs regulations in order to implement electronic filing and records applications for all cases before the immigration courts and the Board of Immigration Appeals BIA. The NPRM also proposed amendments to the regulations regarding law student filing and accompaniment procedures.
This final rule responds to comments received in response to the NPRM and adopts the NPRM with changes as described below.
DATES: This rule is effective on February 11, 2022.

SUMMARY:
I. Notice of Proposed Rulemaking On December 4, 2020, EOIR published an NPRM in the Federal Register, proposing to amend EOIRs regulations in order to implement electronic filing and records applications, known as EOIRs Courts & Appeals System ECAS, for all cases before the immigration courts and the BIA, as well as to update law student filing and accompaniment procedures. See Executive Office for Immigration Review Electronic Case Access and Filing, 85 FR 78240 Dec. 4, 2020.
The NPRM proposed revisions to 8
CFR parts 1001, 1003, 1208, 1240, 1245, 1246, and 1292. These revisions included: 1 Adding or updating relevant definitions; 2 mandating electronic filing, subject to certain
