Comments, Protests, or Motions to Intervene: Anyone may submit comments, a protest, or a motion to intervene in accordance with the requirements of Rules of Practice and Procedure, 18 CFR 385.210, .211, .214, respectively. In determining the appropriate action to take, the Commission will consider all protests or other comments filed, but only those who file a motion to intervene in accordance with the Commissions Rules may become a party to the proceeding. Any comments, protests, or motions to intervene must be received on or before the specified comment date for the particular application.

Any filing must 1 bear in all capital letters the title COMMENTS, PROTEST, or MOTION TO
INTERVENE as applicable; 2 set forth in the heading the name of the applicant and the project number of the application to which the filing responds; 3 furnish the name, address, and telephone number of the person commenting, protesting or intervening;
and 4 otherwise comply with the requirements of 18 CFR 385.2001
through 385.2005. All comments, motions to intervene, or protests must set forth their evidentiary basis. Any filing made by an intervenor must be accompanied by proof of service on all persons listed in the service list prepared by the Commission in this proceeding, in accordance with 18 CFR
385.2010.

Maine DEP, in conjunction with the above captioned project. On October 20, 2021, Brookfield filed documentation of the date that Maine DEP received the application. Pursuant to 40 CFR 121.6, we hereby notify the Maine DEP of the following:
Date of Receipt of the Certification Request: October 18, 2021.
Reasonable Period of Time to Act on the Certification Request: One year.
Date Waiver Occurs for Failure to Act:
October 18, 2022.
If the Maine DEP fails or refuses to act on the water quality certification request by the above waiver date, then the agencys certifying authority is deemed waived pursuant to section 401a1 of the Clean Water Act, 33 U.S.C.
1341a1.

Algonquin Northern Maine Generating Company; Notice of Availability of Environmental Assessment In accordance with the National Environmental Policy Act of 1969 and the Federal Energy Regulatory Commissions Commission regulations, 18 CFR part 380, the Office of Energy Projects has reviewed the application for a subsequent license for the Scopan Hydroelectric Project No.
2368, located on Scopan Stream in Aroostook County, Maine, and has prepared an Environmental Assessment EA for the project. No federal land would be occupied by project works or located within the project boundary.
The EA contains staffs analysis of the potential environmental impacts of the project and concludes that licensing the project, with appropriate environmental protective measures, would not constitute a major federal action that would significantly affect the quality of the human environment.
The Commission provides all interested persons with an opportunity to view and/or print the EA via the internet through the Commissions Home Page http www.ferc.gov using the eLibrary link.
