SUMMARY: On April 1, 2021, the Department of Commerce Commerce initiated an administrative review of the antidumping duty AD order on certain frozen warmwater shrimp shrimp from India for the period February 1, 2020, through January 31, 2021, for 239
companies. Because all interested parties timely withdrew their requests for administrative review for certain companies, we are rescinding this administrative review with respect to those companies. For a list of the companies for which we are rescinding this review, see Appendix I to this notice. For a list of the companies for which the review is continuing, see Appendix II to this notice.

Background On February 2, 2021, Commerce published in the Federal Register a notice of opportunity to request an administrative review of the antidumping duty order on frozen warmwater shrimp from India for the period February 1, 2020, through January 31, 2021.1 In February and March 2021, Commerce received timely requests, in accordance with section 751a of the Tariff Act of 1930, as amended the Act, to conduct an administrative review of this antidumping duty order from the Ad Hoc Shrimp Trade Action Committee the petitioner, the American Shrimp 1 See Antidumping or Countervailing Duty Order, Finding, or Suspended Investigation; Opportunity to Request Administrative Review, 86 FR 7855

Processors Association ASPA, and certain individual companies. Based upon these requests, on April 1, 2021, in accordance with section 751a of the Act, Commerce published in the Federal Register a notice of initiation listing 239 companies for which Commerce received timely requests for review.2
In May and June 2021, all interested parties timely withdrew their requests for an administrative review of certain companies.3 These companies are listed in Appendix I.
Partial Rescission Pursuant to 19 CFR 351.213d1, the Secretary will rescind an administrative review, in whole or in part, if a party who requested the review withdraws the request within 90 days of the date of publication of notice of initiation of the requested review. As noted above, certain parties withdrew their requests for review by the 90-day deadline.
Accordingly, we are rescinding this administrative review with respect to the companies listed in Appendix I.
Assessment Commerce will instruct U.S. Customs and Border Protection CBP to assess antidumping duties on all appropriate entries. Antidumping duties shall be assessed at rates equal to the cash deposit of estimated antidumping duties required at the time of entry, or withdrawal from warehouse, for consumption, in accordance with 19

CFR 351.212c1i. Commerce intends to issue appropriate assessment instructions to CBP no earlier than 35
days after publication of this notice in the Federal Register.
Notification to Importers This notice serves as a reminder to importers of their responsibility under 19 CFR 351.402f2 to file a certificate regarding the reimbursement of antidumping duties prior to liquidation of the relevant entries during this review period. Failure to comply with this requirement could result in Commerces presumption that reimbursement of antidumping duties occurred and the subsequent assessment of doubled antidumping duties.
Notification Regarding Administrative Protective Orders This notice also serves as a reminder to parties subject to administrative protective order APO of their responsibility concerning the return or destruction of proprietary information disclosed under APO in accordance with 19 CFR 351.305. Timely written notification of the return/destruction of APO materials or conversion to judicial protective order is hereby requested.
Failure to comply with the regulations and terms of an APO is a violation which is subject to sanction.
Notification to Interested Parties This notice is issued and published in accordance with section 751a1 of the Act and 19 CFR 351.213d4.
