3. Section 483.430 is amended by adding paragraph f to read as follows:

f Standard: COVID19 vaccines. The facility maintains documentation related to staff that includes at a minimum, all of the following:
1 Staff were provided education regarding the benefits and risks and potential side effects associated with the COVID19 vaccine.
2 Staff were offered COVID19
vaccine or information on obtaining the COVID19 vaccine.
4. Section 483.460 is amended by redesignating paragraph a4 as paragraph a5 and adding new paragraph a4 to read as follows:
483.460 Conditions of participation:

4 The intermediate care facility for individuals with intellectual disabilities ICF/IID must develop and implement policies and procedures to ensure all of the following:
i When COVID19 vaccine is available to the facility, each client and staff member is offered the COVID19
vaccine unless the immunization is medically contraindicated or the client or staff member has already been immunized.
ii Before offering COVID19 vaccine, all staff members are provided with education regarding the benefits and risks and potential side effects associated with the vaccine.
iii Before offering COVID19
vaccine, each client or the clients representative receives education

iv In situations where COVID19

v The client, clients representative, or staff member has the opportunity to accept or refuse COVID19 vaccine, and change their decision.
vi The clients medical record includes documentation that indicates, at a minimum, the following:
A That the client or clients representative was provided education regarding the benefits and risks and potential side effects of COVID19
vaccine; and B Each dose of COVID19 vaccine administered to the client; or C If the client did not receive the COVID19 vaccine due to medical contraindications or refusal.
