Pursuant to the m arketing agreement, as amended, and O rd er No. 36, as amended 7 C F R P a rt 936, regulating the handling o f fresh B artlett pears, plums, and E lberta peaches, grow n in the State o f California, effective under the applicable provisions o f the A gricultural M arketing Agreem ent A ct of 1937, as am ended 7 U. S. C. 601 et seq., and upon the basis o f the recommendation o f the Control Committee established pursuant to said am ended m arketing agreem ent and order as the agency to adm inister the provisions th ereo f, and upon other available inform ation, it is hereby found that the am endm ent o f the rules and regulations 7 C F R P a rt 936.100
et seq.; Subpart Rules and R egu la tion s, as hereinafter set forth, is in accordance with provisions o f said am ended m arketing agreem ent and order and w ill tend to effectuate the declared policy o f the act.
T h e said rules and regulations are hereby am ended by deleting therefrom 936.142 Plums; standard pack; diam

It is hereby fu rth er foun d th at it is impracticable, unnecessary, and con trary to the public interest to give p re lim inary notice, engage in public ru lem aking procedure, and that good cause exists fo r not postponing the effective date hereof until 30 days after publica tion in the F ederal R egister 5 U .
