Part 4b of the Civil A ir Regulations jwitains rules governing the design o f ansport category airplanes.

bine-powered airplanes with but one ex ception; namely, airplane performance.
I n the future, fu rth er amendments to this part, other than those relating to perform ance, w ill be comparatively m inor in nature m ainly reflecting the latest experience in the certification and operation o f these airplanes.
T h e perform ance requirements pres ently in P a rt 4b were first prom ulgated alm ost twelve years ago. They are now considered by the B o ard to be in a form not suitable fo r direct application to turbine-powered airplanes.
T h e Adm inistrator of Civil A eronau tics is in receipt o f a large num ber of applications fo r type certification of turbine-pow ered airplanes.
However, the so-called non-retroactive clause of 4 b .ll a of P a rt 4b does not make applicable to a particular airplane type any amendment which is adopted after an application is filed by the m anu facturer fo r type certification of that airplane. Thus, most o f these airplanes are not now required to meet some of the latest effective provisions of P a rt 4b un
less the B o ard prescribes otherwise.
W ith so m any applications fo r type cer tificates pending, it is essential that the B o ard establish adequate requirements which w ill effectively apply to the type certification o f turbine-powered trans port category airplanes.
This Special Civil A ir Regulation is being prom ul gated fo r that purpose.
T h is Special Civil A ir Regulation is being m ade effective with respect to all turbine-powered transport category a ir planes not yet certificated. In essence, it prescribes a revised set of perform ance requirements fo r turbine-powered a ir planes and incorporates such o f the recent amendments to P a rt 4b as the Adm inistrator finds necessary to insure that the level o f safety of turbinepowered airplanes is equivalent to that generally intended by P a rt 4b.
T h e perform ance requirements con tained herein include not only the per form ance requirements necessary fo r the certification of an airplane, but also the complementary perform ance operating limitations as applicable un der Parts 40, Continued on p. 5947
