R egulations MISCELLANEOUS AMENDMENTS
Sections 38.102 f , 38.204 a and the headnote and paragraph a o f 38.205
are amended, and 38.205 b and 38.206 are added as set out below.
38.102 Definitions.
f State License means a drivers license of the State, District o f Columbia, Territory or possession, in which the employee is domiciled or principally employed.
38.204 Identification Card in pos session. a An Identification Card must be in an employees possession a t all times while driving a Government-owned motor vehicle.
38.205 Renewal and reissuance of Identification Cards, a Identification Cards shall be valid fo r not m ore than three years, and shall be renewable fo r additional periods o f not more than three years each.
b Identification Cards may be re newed or reissued only after agency heads or their designated representatives have determined that the employees con cerned continue to meet prescribed phys ical standards and continued to demon strate competence in driving the motor vehicles to which assigned.
38.206 State license in possession.
a A valid State license must be in an employees possession at all times while driving a Government-owned m otor ve hicle on public highways.

Findings.
1 Pursuant to the m ar keting agreement, as amended, and O r der No. 53, as amended 7 C F R P a rt 953, regulating the handling o f lemons grown in C alifornia and Arizona, effective un der the applicable provisions o f the A g r i cultural M arketing Agreem ent A c t o f 1937, as amended 7 U. S. C. 601 et seq.;
68 Stat. 906, 1047, and upon the basis o f the recommendation and inform ation submitted by the Lem on Adm inistrative Committee, established under the said amended m arketing agreem ent and or der, and upon other available in form a tion, it is hereby found that the lim ita tion o f handling o f such lemons as hereinafter provided w ill tend to effec tuate the declared policy o f the act.
2 I t is hereby further found that it is impracticable and contrary to the pub lic interest to give prelim inary notice, engage in public rule-m aking procedure, and postpone the effective date o f this amendment until 30 days after publica tion h ere o fin the F ederal R egister 60
Stat. 237; 5 U. S. C. 1001 et seq. be cause the tim e intervening between the date when inform ation upon which this amendment is based became available and the time when this amendment must become effective in order to effectuate the declared policy o f the Agricultural M arketing Agreem ent A ct o f 1937, as amended, is insufficient, and this am end m ent relieves restriction on the handling o f lemons grown in C alifornia and Arizona.
