DETERMINATION WITH RESPECT TO TYPES OP
PEANUTS IN INSUFFICIENT SUPPLY FOR
THE 1952-53 MARKETING YEAR
The purpose of this proclamation is to establish the types of peanuts for which the supply for the marketing year beginning August 1, 1952, will be insufficient to meet the estimated de mand for cleaning and shelling pur poses, to establish the extent of increase in State allotments for States producing peanuts of such types required to meet such demand, and to apportion such in crease to such States. These determina tions are made pursuant to section 358
c of the Agricultural Adjustment Act of 1938, as amended 7 U. S. C. 1358 c , which reads in part as follows:
Notwithstanding any other provision of law, if the Secretary of Agriculture deter mines, on the basis of the average yield per acre of peanuts by types during the preced ing five years, adjusted for trends in yields and abnormal conditions of production a f fecting yields in such five years, that the sup ply of any type or types of peanuts for any marketing year, beginning with the 1951-52
marketing year, will be insufficient to meet the estimated demand for cleaning and shelling purposes at prices at which the Commodity Credit Corporation may sell for such purposes peanuts owned or controlled by it, the State allotments for those States producing such type or types of peanuts shall be increased to the extent determined by the Secretary to be required to meet such demand but the allotment for any State may not be increased under this provision above the 1947 harvested acreage ofpeanuts for such State. The total increase so deter mined shall be apportioned among such States for distribution among farms pro ducing peanuts of such type or types on the basis of the average acreage of peanuts of sdch type or types in the three years im mediately preceding the year for which the allotments are being determined. The ad ditional acreage so required shall be in addi tion to the national acreage allotment, the
production from such acreage shall be in addition to the national marketing quota, and the increasein acreage allotted under this provision shall not be considered in es tablishing future State, county, or farm acre age allotments.
Section 729.305 of this proclamation defines each of the four commonly known basic types of peanuts Runner, Span ish, Valencia, and Virginia by describ ing the outstanding physical character istics of each type and th areas of the United States in which each is most commonly grown. The definition of Vir ginia type peanuts includes a require ment that each lot or load of peanuts having Virginia type characteristics must contain a minimum percentage of large, so-called Fancy , size peanuts, otherwise such lot or load will be con sidered Runner type peanuts.
Section 729.306 establishes the types of peanuts for which the supply for the marketing year beginning August 1,1952, will be insufficient to meet the estimated demand for cleaning and shelling pur poses at prices at which Commodity Credit Corporation may sell for such pur poses peanuts owned or controlled by it.
This determination is based on the esti mated production of each type of pea nuts on the State allotments previously announced for the 1952 crop, on the basis of the average yield per acre o f x peanuts by types in the five years 194751, adjusted for trends in yields and for abnormal conditions of production a f fecting yields in thpse years. Section 729.306 also establishes the total increase in State allotments required to meet the prescribed demand for peanuts of the types for which an increase is provided.
Section 729.307 apportions the in crease determined under 729.306 to States producing peanuts of the types for which such increase is provided.
Such increase is prorated to such States on the basis of the average acreage of peanuts excluding acreage in excess of farm allotments of such types grown in each State in the three years 1949-51, but the allotment for no State is in creased above the 1947 harvested acreage of peanuts for the State.
