E x e m p t io n s IRREGULAR AIR CARRIERS
Adopted by the Civil Aeronautics Board at its office in Washington, D. C.f on the 10th day of December 1948.
The following interpretation of the Economic Regulations 292.1, in the form of illustrative examples of irregular air transportation as therein defined, is being promulgated pursuant to section 205 a of the Civil Aeronautics Act and section 3 a of the Administrative Pro cedure Act. It is adopted as part of the regulations. Its purpose is to assist ir regular air carriers to conduct their oper ations in conformity with the act and 292.1 of the Economic Regulations.
In consideration of the foregoing, the Civil Aeronautics Board hereby issues the following interpretation of 292.1:
Examples of-Irregular Air Transporta tion within the meaning of 292.1. For the guidance of Irregular Air Carriers and other interested parties the Board here sets forth a number of illustrative examples of irregular and regular service.
All Irregular Air Carriers should study these examples, for the Board expects to use them as standards to apply to the operations of such Carriers.
It should be noted that all of the illus trations included here refer only to actual operations. Such operations in dicate a course of conduct constituting the holding out of regular or irregular service, as the case may be. The holding out of regular service may also be brought about by means other than actual opera tionsfor example, although its services re updated irregularly, a carrier.may be holding out regular service by reason pi the nature and extent of its advertis-
mg and traffic solicitation efforts. In other words, an Irregular Air Carrier is not immune from enforcement action if its actual operations are irregular but all the circumstances surrounding its busi ness show that the carrier Js holding out regular service.
