The said order, as amended and as hereby further amended, regulates the handling of milk in the same manner as and is applicable only to persons in the respective classes of industrial and com mercial activity specified in a marketing agreement upon which hearings have been held.
The foregoing findings are supple mentary and in addition to the findings made in connection with the issuance of the aforesaid order and the findings made in connection with the issuance of each of the previously issued amend ments thereto; and all of said previous findings are hereby ratified and affirmed except insofar as such findings may be in conflict with the findings set forth herein.
b Determinations. . It is hereby de termined that handlers excluding co operative associations of producers who are not engaged in processing, distribut ing, or shipping the milk covered by this order, as amended of more than 50 per cent of the volume of milk covered by the aforesaid order, as amended and as hereby further amended, which is marketed within the New York metro politan milk marketing area, refused or failed to sign the marketing agreement regulating the handling of milk in the said marketing area which was hereto fore approved by the Secretary of Agri culture 12 F. R. 4413, 4418 ; and it is hereby further determined that:
1 The refusal or failure of such handlers to sign said marketing agree ment tends to prevent the effectuation of the declared policy of the act;
2 The issuance of this order further amending the said order, as amended, is the only practical means, pursuant to the declared policy of the act, of advanc ing the interests of producers of milk
