In the matter of the petition for amendment of Child Labor Regulation No. 3 to permit the employment of minors between the ages of 14 and 16
years in the picking of turkeys.
Whereas the Chief of the Childrens Bureau, United States Department of Labor, issued Child Labor Regulation No. 3 Part 441, Chapter IV, Title 29, Code of Federal Regulations, effective May 24,1939, providing that the employ ment of minors between the ages of 14
and 16 years under specified conditions in all occupations other than those spe cifically excepted by such regulation shall not be deemed to constitute op pressive child labor, and Whereas among the occupations ex cepted from the scope of Child Labor Regulation No. 3 are all processing occu pations, including occupations requiring the performance of any duties in work rooms or workplaces where goods are processed, and Whereas a petition was received from certain operators of establishments en gaged in the handling, slaughtering, and dressing of poultry located in the State of Texas, requesting authority to em ploy minors between 14 and 16 years of age in the picking of turkeys, a proc essing occupation in which the employ ment of such minors now constitutes oppressive child labor, and Whereas the question raised by said petition appeared to be a question of interest to all operators of establishments engaged in the handling, slaughtering, and dressing of poultry, and Whereas, after notice duly published in the F ederal R egister, a public hearing was held on November 3, 1943, for the purpose of affording interested parties
an opportunity to be heard upon the fol lowing issues:
1. In what occupations, ii any, is the em ploym ent in poultry handling, slaughtering, and dressing establishments of minors be tween the ages of 14 and 16 years in the handling, slaughtering, or dressing of poultry necessary for the war effort, and 2. If such employment of minors between th e ages of 14 and 16 years is found to be necessary for th e war effort, w hat safeguards should be established to protect th eir school ing and their health and well-being,
