By virtue of the authority vested in me by the Constitution and statutes, as President of the United States and Com mander in Chief of the Arm y and Navy, and in order to facilitate the perform
ance of the responsibilities of the Petro leum Administrator, p aragraph 7 of E x ecutive Order No. 9276 of December 2, 1942, entitled Establishing the Petro leum Administration for W a r and D e fining Its Functions and Duties ,1 is hereby amended to read as follows:
7. The Administrator m ay appoint, with the approval o f the President, a Deputy Administrator, who shall report directly to the Administrator, and to whom he may delegate any and all power, authority, and discretion conferred upon him by this Order. The Deputy Adm in istrator shall serve as Acting Adminis trator in the absence o f the Adm inistra tor. The Administrator and Deputy A d
ministrator m ay a exercise the powers, authority, and discretion conferred upon them by or under the provisions of this Order through such personnel of the Petroleum Administration for W a r and in such m anner as the Administrator or Deputy Administrator may determine, and b accept the services of other agencies and officials of the Government in carrying out the purposes of this O r der. The Administrator, within the lim
its of such funds as may be allocated or appropriated fo r the purpose, may em ploy necessary personnel and make pro vision for necessary supplies, facilities, travel, and services.
B y virtue of the authority vested in me by the Constitution and laws of the United States, and as President of the United States and as Commander in C hief of the Arm y and Navy, Executive Order No. 9108 of M arch 21, 1942,1 di recting the Director of the Office of D e fense Transportation to take possession of the property, franchises, rights and other assets of the Toledo, Peoria and W estern Railroad therein referred to as the Toledo, Peoria and W estern R a il road C om pany, is hereby amended by inserting, after paragraph 5 thereof, a new paragraph, reading as follows:
6. As part of the terms and conditions o f the possession and operation directed to be taken hereunder, the Director of the Office of Defense Transportation is authorized in his discretion to make ad
vances from the net cash earnings of his operation of the railroad, in such amounts and on such terms as he deems desirable, fo r the discharge of law ful obligations o f the Toledo, Peoria and Western Railroad, and fo r the preserva tion o f the real and personal property, corporate organization and franchises, rights and other assets, tangible and in
tangible, of the Toledo, Peoria and W est ern Railroad, but not including payment o f executive salaries beyond amounts he deems necessary for the foregoing p ur poses and not including payment of divi dends. Advances pursuant to the au thority of this p aragraph shall not be repayable before the time of final deter mination, by settlement or adjudication, of the claim of the Toledo, Peoria and W estern R ailroad for compensation by reason of action taken pursuant to this order.
