The President EXECUTIVE ORDER
E stablishing a W ar S hipping A dminis
tration in the E xecutive Office of the P resident and D efining I ts F unc tions and D uties v

By virtue of the authority vested in me by the Constitution and Statutes of the United States, including the First War Powers Act, 1941, approved December 18, 1941, as President of the United States and Commander in Chief of the Army and Navy, and in order to assure the most effective utilization of the shipping of the United States for the successful prosecu tion of the war, it is hereby ordered:
1, There is established within the Office for Emergency Management of the Exec utive Office of the President a War Shipping Administration under the di rection of an Administrator who shall be appointed by and responsible to the Pres ident.
2. The Administrator shall perform the following functions and duties:
a. Control the operation, purchase, charter, requisition, and use of all ocean vessels under the flag or control of the United States, except 1 combatant ves sels of the Army, Navy, and Coast Guard;
fleet auxiliaries of the Navy; and trans ports owned by the Army and Navy; and 2 vessels engaged in coastwise, inter coastal, and inland transportation under the control of the Director of the Office of Defense Transportation.
b. Allocate vessels under the flag or control of the United States for use by the Army, Navy, other Federal depart ments and agencies, and the govern ments of the United Nations.
c. Provide marine insurance and rein surance against loss or damage by the risks of war as authorized by Title n of the Merchant Marine Act, 1936, as amended.
d. Establish the conditions to be com plied with as a condition to receiving priorities and other advantages as pro vided in Public Law 173, Seventy-Seventh Congress, approved July 14, 1941.

e. Represent the United States Gov ernment in dealing with the British Min istry of War Transport and with sim ilar shipping agencies of nations allied with the United States in the prosecu tion of the war, in matters related to the use of shipping.
f. Maintain current data on the avail ability of shipping in being and under construction and furnish such data on request to the Departments of War and the Navy, and other Federal departments and agencies concerned with the import or export of war materials and commod ities.
g. Keep the President informed with regard to the progress made in carrying out this Order and perform such related duties as the President shall from time to time assign or delegate to him.
3. The functions, duties, and powers conferred by law upon the United States Maritime Commission with respect to the operation, purchase, charter, insur ance, repair, maintenance, and requisi tion of vessels, and the issuance of war rants with respect thereto, under the Merchant Marine Act of 1936 as amended, 49 Stat. 1985, Public Law 101
Seventy-Seventh Congress, approved June 6, 1941, and Executive Order 8771
issued pursuant thereto, Public Law 173, Seventy-Seventh Congress, approved July 14, 1941, are hereby transferred to the Administrator; and such part of ex isting personnel of the United States Maritime Commission together with such records and public property as the Ad ministrator may deem necessary to thefull exercise of his functions and duties prescribed by this Order are hereby as signed to the War Shipping Adminis tration.
4. Vessels under the control of the War Shipping Administration shall constitute a pool to be allocated by the Administra tor for use by the Army, Navy, other Fed eral departments and agencies, and the governments of the United Nations. In allocating the use of such vessels, the Administrator shall comply with stra tegic military requirements.
5. For the purpose of carrying out the provisions of this Order, the Administra tor is authorized to utilize the services
