Upon petition filed by the TruaxTraer Coal Company, o f M inot, North Dakota, fo r leave to intervene and be come a party to the proceeding before the Commission on the application of the Kansas Pipe Line & Gas Company, filed on September 10, 1938, fo r a certificate of public convenience and necessity pur suant to Section 7 c o f the Natural Gas Act;
The Commission orders that:

Oral argument on said petition be heard on October 21, 1938, at 10:00 a. m.
in the Hearing Room o f the Federal Power Commission, Hurley - W right Building, 1800 Pennsylvania Avenue NW., Washington, D. C., such argument to cover the follow ing questions:
A W hether the petitioner is a com petitor o f the applicant company within the meaning of Section 15 a of the Natural Gas Act and as such should be permitted to intervene in this proceed ing;
B Whether, and if so, to what ex tent, the participation o f the petitioner in this proceeding w ill be in the public interest;
C W hether the Natural Gas Act re quires or contemplates that the Commis sion, in determining the question o f pub lic convenience and necessity in this pro ceeding, shall consider the effect which the construction or extension of fa cil ities by a natural-gas company and the
