In response to OMBs Bulletin, DOE
conducted formal peer reviews of the energy conservation standards development process and the analyses that are typically used and has prepared a report describing that peer review.15
Generation of this report involved a rigorous, formal, and documented evaluation using objective criteria and qualified and independent reviewers to make a judgment as to the technical/
scientific/business merit, the actual or anticipated results, and the productivity and management effectiveness of programs and/or projects. DOE has determined that the peer-reviewed analytical process continues to reflect current practice, and the Department followed that process for developing energy conservation standards in the case of the present rulemaking.
VI. Approval of the Office of the Secretary The Secretary of Energy has approved publication of this final determination.

ACTION: Final special conditions; request for comments.
AGENCY:

These special conditions are issued for the Boeing Model 777200/
200LR/300/300ER Series Airplanes.
These airplanes, as modified by Archeion Holdings, LLC Archeion, will have a novel or unusual design feature when compared to the state of technology envisioned in the airworthiness standards for transport category airplanes. This design feature is a digital systems architecture for the installation of a system with wireless network and hosted application functionality that allows access from external sources to the airplanes internal electronic components. The applicable airworthiness regulations do not contain adequate or appropriate safety standards for this design feature.
These special conditions contain the additional safety standards that the Administrator considers necessary to establish a level of safety equivalent to that established by the existing airworthiness standards.
