to be adversely affected by a release or potential release from a CCR unit located in the state for which the program was approved.
RCRA section 4005d4B also provides that in a state with an approved CCR permitting program, the Administrator may commence an administrative or judicial enforcement action under section 3008 if:
The state requests that the Administrator provide assistance in the performance of an enforcement action;
or After consideration of any other administrative or judicial enforcement action involving the CCR unit, the Administrator determines that an enforcement action is likely to be necessary to ensure that the CCR unit is operating in accordance with the criteria established under the states permit program.
V. Action In accordance with 42 U.S.C. 6945d, EPA is approving the Texas partial CCR
state permit program.
