Subpart Regulations Pertaining to Rice Marketing Quotas Miscellaneous A mendments
The purpose of the amendments herein is l to change the definition of rice acreage relative to rice produced on a wildlife refuge farm; 2 to permit the issuance of a marketing card to a mul tiple producer when he has no interest in a farm which is in excess; 3 to extend present language, with respect to issuing marketing certificates to include experi mental rice farms; 4 to announce-the rate of penalty applicable to the 1959
crop of rice; 5 to clarify present language with respect to a buyers responsi bly for collecting the penalty due on xcess stored rice a t the time of any unauthorized depletion; 6 to clarify i f angua&e with respect to the uostitution of excess rice in the case of
licensed storage; 7 to require th a t acreage in the conservation reserve of the soil bank, be considered rice acreage when determining the amount of excess penalty rice th at may be removed from storage; 8 to preclude the use of underplanted allotment on governmentowned land under a restrictive lease for removing excess penalty rice from stor age; 9 to require th at acreage con sidered rice acreage under a conserva tion reserve contract, be deemed to have produced the normal production of rice when determining the actual production for the farm; 10 to require th at excess rice delivered to the Secretary in satis faction of the penalty, be clear of all encumbrances; 11 to authorize under certain conditions the issuance of a marketing certificate in lieu of a market ing card to an agricultural experiment station; and 12 to clarify present lan guage regarding the marketing of within quota rice produced on wildlife refuge farms.
The amendment with respect to the definition of rice acreage referred to herein is necessary because of an amend ment to P art 719Reconstitution of Farms, Farm Allotments and Farm His tory and Soil Bank Base Acreages 23
FJR. 10476. The amendments with re spect to marketing cards and marketing certificates, collection of penalty by the buyer upon unauthorized depletion of excess rice in storage, the substitution of excess rice in storage, the requirement th at conservation reserve acreage be considered rice acreage when determin ing the amount of excess penalty rice th at may be removed from storage, the preclusion of the use of underplanted allotment on government-owned land under a restrictive lease for removing excess penalty rice from storage, and the requirement th at rice delivered to the Secretary be free of all encumbrances are considered necessary to facilitate administration of the marketing quota program. The amendment with respect to the penalty rate is necessary because of the recent announcement of the parity price per pound for rice as of June 15, 1959.
Since farmers have already planted the 1959 crop of rice and soon will be making plans to harvest such crop, it is imperative th at they be notified of these amendments as soon as possible. AcContinued on p. 5625
