MISCELLANEOUS AMENDMENTS

Pursuant to the authority contained in Parts I and IV of Executive Order No.
10000, dated September 16, 1948, as amended by Executive Order No. 10623,1
dated July 23, 1955 and by Executive Order No. 10636,2 dated September 16, 1955, in section 443 of the Foreign Serv ice Act of 1946 60 Stat. 1006; 22 U. S. C.
888 , as amended, and in section 207 of the Independent Offices Appropriation Act, 1949, as amended by section 104 of the Supplemental Independent Offices Appropriation Act, 1949 <62 Stat. 1205;
5 U. S. C. 118th Supp., Part 325, Chapter III, Title 5 of the Code of Federal Regu lations is hereby amended effective as of the beginning of the first pay period-fol lowing January 1, 1959. Section 325.11
is re-numbered 325.15. Sections 325.1
through 325.10 and 325.12 and 325.13
are deleted and the following is sub stituted in lieu thereof:
5 325.1 Definitions. As used in this part the following have the meanings indicated :
a Differential covers both the foreign post differential established in Part I of Executive Order 10000 of Sep tember 16, 1948, as amended, and the salary differential established by sec tion 443 of the Foreign Service Act of 1946, as amended. It means the addi tional compensation over base salary payable to éligible personnel at differ ential posts or in differential areas.
b Agency ntans any executive department, independent board, bureau, commission, establishment, or other agency of the Federal Government; or any corporation wholly owned either directly or through one or more corpora tions by the United States. agency or anyone designated by him to make determinations in his behalf.
c Foreign areas means all areas not include in the continental United States and the territories and possessions of the United States.
d Territories and possessions of the United States means Alaska, Hawaii, the Commonwealth of Puerto Rico, the possessions of the United States includ ing Canton and Enderbnry Islands in the Phoenix Group ; and also the Trust Territory of the Pacific Islands and the Panama Canal Zone.
e United States includes the areas enumerated in paragraph d of this section. Continental United States means the States and the District of Columbia.
f Basic compensation means the rate of compensation fixed by law for the position held by an individual, before any deduction is made and exclusive of additional compensation of any kind, such as overtime pay, extra pay for work on holidays, differentials and allowances.
g Detail for the purpose of differ ential means temporary assignment or temporary duty including temporary duty for consultation for a minimum of 24 consecutive hours, counted from the time of arrival, at a post other than the employees regular postxof assignment, including also all periods of authorized leave with pay while serving at the post of temporary assignment or temporary duty.
h Day in 325.5 d means each midnight, including the midnight of the 24-hour period required by paragraph g of this section, occurring while the employee is on detail at a differential post.
i Assigned or on assignment to a post means officially occupying a posi tion located at the post, geographically and organizationally, and having official headquarters at the post for travel and other administrative purposes.
j Differential post means a post, or a location in an area, listed in 325.15.
k Contract means a legally bind ing document specifying, for an employée whose rate of basic compensation is fixed by statute, the compensation to be paid during his employment outside the conContinued on next page
