Adopted by the Civil Aeronautics Board at its office in Washington, D. C., on the 17th day of February 1955.
On January 11, 1952, the Board adopted Special Civil Air Regulation SR378, which provided th at air taxi oper ators as defined in 298.1 a 2 of P art
298 of the Boards Economic Regulations, shall be certificated and shall conduct operations in accordance with the appli cable provisions of Part 42 of the Civil Air Regulations. Subsequently, on June 1, 1953, the Board adopted currently ef fective Special Civil Air Regulation SR
395, which superseded SR-378 and pro vided th at air taxi operator certificates should continue in effect until the ter mination of the economic exemption authority contained in Part 298, namely, until February 20, 1955. On December 21, 1954, the Board issued a notice of proposed rule-making Economic Regu lations Draft Release No. 71, which proposed to delete the economic exemp tion authority termination date of Feb ruary 20,1955, which existed in Part 298.
This proposal would have put the exemp tion authority granted to air taxi oper ators oh a permanent basis.
The Board concurrently with the issuance of this Special Civil Air Regu lation is extending the exemption au thority contained in P art 298 pending final determination as to the proper economic limitations which should be imposed on air taxi operators. It ap pears certain, however, th at some form of economic exemption authority for air taxi operators will be continued on a permanent basis. I t therefore is desir able to extend Special Civil Air Regula tion SR-395 to provide for such operations.
Part 42 of the Civil Air Regulations is presently undergoing revision. This proposed revision would make P art 42
applicable solely to large aircraft; and it would be necessary to prepare a new part for the certification and operation of small aircraft air taxi operators.
Revised P art 42 and proposed regula tions to cover air taxi operations are presently being prepared in draft release form, and it is estimated that they will be adopted by the Board for circulation as a notice of proposed rule-making in the near future. For this reason, Special Civil Air Regulation SR--395 is being ex tended until such time as a new perma nent Part, covering the certification and operation of small aircraft, becomes effective. Noticevof this extension was published in the F ederal R egister on January 19, 1955, at 20 F. R. 422.
Interested persons have been afforded an opportunity to participate in the making of this regulation, and due con sideration has been given to all relevant matter presented. Since this regulation imposes no additional burden on any person, it may be made effective without prior notice.
In consideration of the foregoing, the Civil Aeronautics Board hereby makes and promulgates the following Special Civil Air Regulation, effective February 20, 1955:
Notwithstanding the provisions of Parts 40 and 41 of the Civil Air Regulations, any air taxi operator as defined in 298.1 a 2
of Part 298 of the Boards Economic Regula tions shall be certificated and shall conduct operations in air transportation in accord ance with the provisions of Part 42 of the Civil Air Regulations: Provided, That any air carrier operating certificate Issued for air taxi operations which is in effect on, or Issued after, the effective date of this regulation shall remain in effect until the expiration
of this special regulation, unless such certifi cate is sooner surrendered, suspended, or revoked.

This regulation supersedes Special Civil Air Regulation SR-395 and shall remain in effect until such time as new air taxi certification and operation rules become effective, unless sooner termi nated or rescinded by the Board.

P art 298Classification and E xemption of Air T axi Operators TEMPORARY EXTENSION OF EXEMPTIONS FOR
AIR TAXI OPERATORS

Adopted by the Civil Aeronautics Board at its office in Washington, D. C., on the 17th day of February 1955.
At the present time the exemptions provided by P art 298 of the Boards Eco nomic Regulations will expire on Febru ary 20, 1955. On December 21,1954, the Board issued a notice of proposed rulemaking which proposed to make perma nent the exemptions now afforded air taxi operators. Of the comment which has been received by the Board on this proposal, some favor relaxation of the restrictions imposed on air taxi oper ators, and some urges increased restric tions on competition with other air carriers. In addition, a request has been received to set this m atter down for oral argument before the Board.
The Board is of the opinion th at some extension of the exemptions contained in P art 298 is desirable but th at oral presentation of facts and arguments to the Board is in the public interest, in or der to determine the limitations which should be imposed on air taxi operators on a long-term basis. Accordingly, by notice issued concurrently herewith the Board is setting down for oral argument the question of the proper role of air taxi operators, the manner in which they should be allowed to operate, and the conditions, restrictions, and limitations, if any, which should be imposed while obtaining the benefit of the exemptions afforded by Part 298.
The Board believes that, pending con clusion of oral argument before the Board and decision thereon, the present exemption authority in P art 298 should be extended in its present form. For this reason the Board is extending such ex emptions until the termination of these proceedings.
Interested persons have been afforded an opportunity to participate in the mak ing of this amendment and due consider ation has been given to all relevant m atter submitted. This extension of the exemptions contained in P art 298 is a rule relieving restriction, and therefore
