The purpose of this amendment is to authorize the movement from Hawaii throughout the year of untreated fruit of Solanum mammosum, commonly known as foxheads or nipple fruits. At present treatment is required as a condition of such movement. The amendment there fore relieves a restriction on the move ment of such fruit. Extensive experi mental work conducted in Hawaii has disclosed that such fruit is not a host of the oriental, melon, or Mediterranean fruit fly. Consequently, it has been de termined that treatment is not necessary as a condition of the movement of the fruit and that inspection and certifica tion procedures will give adequate pro tection. This fruit is used as a decora tive material, and commercial growers and florists in Hawaii desire to ship it to mainland markets. In order to be of maximum benefit to persons subject to the present restrictions the amendment should be made effective as promptly as possible.
Therefore, pursuant to paragraphs 4 Ca and c of the Ad ministrative Procedure Act 5 U. S. C.
1003 a and c , it is found upon good cause that notice and other public pro cedure with respect to this amendment are impracticable and contrary to the public interest, and good cause is found for the issuance of the amendment effec tive less than 30 days after publication in the F ederal R e g is t e r .
