A PROCLAMATION
W HEREAS by the Joint Resolution of December 8, 1941 Public Law 328, 77th Congress, the Joint Resolution of De cember 11, 1941 Public Law 331, 77th Congress, and the Joint Resolution of December 11, 1941 Public Law 332, 77th Congress, a state of war was declared between the United States and the Im
perial Government of Japan, the United States and the Government of Germany, and the United States and the Govern ment of Ita ly; and W HEREAS section 318 o f the T ariff Act o f 1930 46 Stat. 696; U. S. C., 1940
ed., title 19, sec. 1318, provides, in part, as follows:
W henever the President shall by procla m ation declare an emergency to exist by reason o f a state o f war, or otherwise, he may authorize th e Secretary o f the Treasury to extend during the continuance o f such emergency th e tim e herein prescribed for the performance o f any act, and may au thorize the Secretary o f tho Treasury to permit, under such regulations as the Secreta j o f th e Treasury m a y , prescribe, the importation free of duty o f food, clothing, and medical, surgical, and other supplies for use in emergency relief work.

W HEREAS under sections 1, 2, and 3
of the Act approved on January 5, 1905, 33 Stat. 599-600 U.S.C., 1940 ed., title 36, secs. 1, 2, and 3 , The American National Red Cross was created a body corporate and politic in the District of Columbia and empowered to do all such acts and things as may be necessary to promote the purposes of such body cor porate and politic, which purposes in clude acting in, carrying on, and admin istering emergency relief:

States o f America, acting under and by virtue o f the authority vested in me by the above-quoted provisions of the T a r iff Act of 1930, do hereby declare an emergency to exist by reason of a state of war, and do hereby authorize the Sec retary of the Treasury to permit until the termination of such state of war un less before that date it has been deter mined by the President and declared by his proclamation that the emergency ex isting by reason of such state of war has term inated, under such regulations as such Secretary may prescribe and sub ject to such conditions as he may deem necessary, the importation f?ee o f duty of food, clothing, and medical, surgical, and other supplies by or directly for the account of The American National Red Cross for use by it in emergency relief work in connection with the aforemen tioned emergency existing by reason of a state of war.
